Home protection and me.

I have read story after story of people shooting intruders, and the intruder sues or the deceased intruders family sues. I've also read stories about the state filing criminal charges over such altercations. My question is should I shoot on sight or not? Should I wait for the intruder to become violent? I fitted my beretta with a laser sight as a less-than-lethal option. I figured the sight of a red dot over your left peck is enough for any home intruder to turn step and boogey out. Does anyone know if this has been an effective deterrent? I live in Colorado if this makes any difference.

In the Peoples Socialist Republic of Illinois I believe you would be charged. I wouldn't because I think people have the right to protect their property and life. I arrested a woman one time that was stabbed 6 times by another woman. I had the stabber in custody and while I did my canvass I found out the stabbee attacked the stabber and kept on attacking while she was stabbing. I let the one lady go and went to the hospital and arrested the other. Here in IL though laws are really goofy. I know they arrested a man up in the burbs for shooting a guy he caught in his house.

Here again is the exact wording from the Colorado Revised Statutes regarding the use of deadly force within your home. This is the so-called "Make my Day" law.

Let me highlight a couple of points here first.

1) your interest on this board sort of seems limited to how/when you can carry a gun, and when/why you can kill people. I'll gladly show you the law, but I am sort of disturbed by your other posts indicating that you live in fear of the police (and debate whether cops are necessary), followed by posts asking how you may kill intruders.

2) The law specifies certain specific elements that must be met before you can use deadly force in the defense of your home. I've bolded these sections below.

The above-listed government site has an obvious link to the online version of the CRS, where you can keyword search for any colorado law you would like. You may also want to check out www.municode.com for specific city ordinances.

HERE IS THE LAW:

18-1-704.5. Use of deadly physical force against an intruder.

The general assembly hereby recognizes that the citizens of Colorado have a right to expect absolute safety within their own homes.

Notwithstanding the provisions of section 18-1-704, any occupant of a dwelling is justified in using any degree of physical force, including deadly physical force, against another person when that other person has made an unlawful entry into the dwelling, and when the occupant has a reasonable belief that such other person has committed a crime in the dwelling in addition to the uninvited entry, or is committing or intends to commit a crime against a person or property in addition to the uninvited entry, and when the occupant reasonably believes that such other person might use any physical force, no matter how slight, against any occupant.
Any occupant of a dwelling using physical force, including deadly physical force, in accordance with the provisions of subsection (2) of this section shall be immune from criminal prosecution for the use of such force.
Any occupant of a dwelling using physical force, including deadly physical force, in accordance with the provisions of subsection (2) of this section shall be immune from any civil liability for injuries or death resulting from the use of such force.

I want to make sure that I am completely legit on the firearms aspect of my life. Also I'd like to thank you for the information you supply me with it has been a great help, so thanks! I think I started off on the wrong foot, I don't have an aversion to police, I believe police are a necessity in our society, undoubtedly. I simply disagree with some of the laws, well actually quite a few of them, I totally respect you guys it's honorable that you put your life at risk on a daily basis for the greater good of a society. I stated that I fear police more than criminals, I can see how you guys are put off by this, all I ask is that you try to see it from a civilian standpoint. Police have the ability to change my life with the stroke of a pen, criminals on the other hand can only harm my person or my belongings. I believe the fear to be properly grounded, hell even a fellow LEO indirectly agreed with me.

Fair enough... And, besides, I'd rather see you get good information by asking the right questions, as opposed to just winging it and getting hung up on illegally carrying a weapon or the like.
