I got a problem
He lives right down the street.
First, before I get into that, I need to say thanks to somebody. I've been thinking about registering on this board so I could do just that but after tonight, I have two reasons.
I'm the webmaster at www.mrcycles.com. We are a dealer in Asheville, N.C. that sells discount OEM motorcycle and ATV parts. This board has been visible and climbing in our list of referals so I owe a thanks to someone out there.
Now, onto the crisis at hand. Needless to say, I live in N.C. Theres a guy that lives down the road from me that goes WAY beyond the textbook definition of redneck. So far as I know he doesn't have a job and he wheels and deals to get by. A few months ago I sold him an old Blazer that I had gotten tired of repairing. The deal was something like $100 and a dryer that was sitting in his yard for the Blazer. I just wanted to get rid of the truck and get this guy out of my yard. Since then I can't seem to get rid of him. He comes down here looking for trouble and tonight he threatened me physically more than a dozen times. He says he sold the truck to a girl and the truck caught fire killing the girl that was in it. He goes on to explain that the folks at some kind of shop has told him that I was aware of some kind of recall that I didn't take care of. Thats why the Blazer caught on fire so I now owe him big time for the truck and the loss of his friend. He says he's tired of me talking trash about him. I don't talk to anybody around here but the guy that sold me my house. Thats only the beginning.
1) I never took that truck to a shop.
2) He preformed all kinds of work on the truck before selling it to this girl.
3) What the hell am I talking about?. None of this has anything to do with reality. This guy is whacked!!!
Now before you start getting the impression I'm spineless, I'm not. In fact, I have anklosyng spondolitis, a form of artritis, and my spine is growing twice its size into one big bone.
I don't know what to do. If I shoot him, I go to jail. He's at the door now. Gotta go.

Just call the cops. Serve him with a notice not to trespass (may be called something different in N.C.) and everytime he comes on your property call the police.
Wait until Terminator responds because he is an N.C. LEO. He will know more then I would about your states laws.
If here were in D.C. that very well might get him locked up depending on what was said. But that really does not help you.

You could also ask the courts for a Restraining Order

Yes it is. It will allow the police to arrest him for violating it. Without that there is not much the police can do.

It should keep him from bothering you unless he is super crazy.

It can be.

In your case, it would send a message to the hillbilly that he'll get arrested every time he gets a bug up his ass and tries to mess with you. Most of the time, people get the message.
Whether it's worth it in your case is up to you.

Any disagreements about the verbal contract you had with him, would be a civil matter, and he would have to sue you in civil court. Police Officers in North Carolina cannot enforce civil matters.
If he is threatening you directly, and you believe the threat is credible, then contact the local authorities and/or go to your local Magistrate's Office and attempt obtain a warrant for his arrest for communicating threats.
If he comes to your property, and you do not want him on your property, contact the local authorities immediately, and don't approach him. Once you or a law enforcement officer has told him to stay off your property, he can be charged with 2nd Degree Trespassing if he returns.

01-11-06, 07:41 PM #17Their is no such thing in North Carolina as a restraining order...so that would not be an option. This state has Domestic Violence Protective Orders only.

I don't think he believes me.
He's looking at at me like I'm putting him on.
He's going to try again. Whats the deal? Is he too busy to deal with it?

01-11-06, 07:46 PM #20What city/county do you live in and what law enforcement agency are you dealing with?
