Being Harassed

Sorry guys, another dilemma. Help!!!
I had a best friend named Erin here at school. Two months ago, we decided to rent a house in town with 2 other girls she's also friends with, Grace and Heidi. Well, a few weeks ago we (me and Erin) had a little spat over something thats not important anymore, and a week after not talking she called me and said, "hey, do you want to come over to the house and help paint three rooms? The landlord says she wont make us pay first month's rent if we paint." So, of course, i go over to help. Everything was great, i painted my entire room, and helped with the other two. i cleaned up most of the kitchen too. Erin came over to me and showed me a picture on her phone of a table set up with a huge game of beer pong, and said "this is what we're doing tonight." I said cool, whatever, because she knows i dont party and likes to make me feel like an ass because i dont. I just think its funny when they all get thrown in the Athens County drunk tank overnight. HAHAAHA but anyway.....
Everything went greeat and i took her and Grace back to the dorm.
Later that night i got a text from her saying "Sarah got off probation and she's moving in instead of you." I tried to call her but she wouldnt answer. I asked why and she replied (text) saying "because".
Well she had sara call me cussing me out calling me a "fucking pig" stupid C*** and i just kept telling her i wanted to have a mature conversation. She hung up on me and Erin kept texting me all night, drunk, stupid stuff trying to get me to argue.....and it went on until the next day until i finally told them if they text me any more harassing bullshit that i would get them for phone harassment. To make a long story short, we made an agreement that Sara would pay me $150 for the lease money i paid for the house and all the work i did in the house. Yesterday she was supposed to pay me and i texted her about it. She said she wouldnt give me the money. So i called the landlord asking for her to help me find a new apartment and just transfer the lease money so i wouldnt have to argue with them about it. I got that worked out, and told them (texting) that they dont have to worry about the money and to erase my number, and never call me or text me again.

Tonight i got a call at 9:41pm from a restricted number. they said nothing. I said "hello" probably ten times and hung up. then again at 11:50 the restricted number rang again. This time, i could hear people talking, but not into the phone. I heard sara's voice, erin's voice, and kyle ( a guy who lives at an apartment uptown who throws a party every tues. night) talking to each other. I couldnt make out what they were saying, but i know it was them. Then after about 30 sec. they hung up.

Ive tried as hard as i could to avoid the bullshit that goes on here....but i never imagined a friend i would do anything for would be so two faced and immature. But now Its getting out of hand. I dont know what to do. I would like to walk down to the campus police station and talk to the officer....but what can they really do about it?

§LRS14:285.
Telephone communications; improper language; harassment;
penalty.

A. No person shall:

(1) Engage in or institute a telephone call, telephone
conversation, or telephone conference, with another person,
anonymously or otherwise, and therein use obscene, profane, vulgar,
lewd, lascivious, or indecent language, or make any suggestion or
proposal of an obscene nature or threaten any illegal or immoral act
with the intent to coerce, intimidate, or harass another person.

(2) Make repeated telephone communications anonymously or
otherwise in a manner reasonably expected to annoy, abuse, torment,
harass, embarrass, or offend another whether or not conversation
ensues.

(3) Make a telephone call and intentionally fail to hang up
or disengage the connection.

(4) Engage in a telephone call, conference, or recorded
communication by using obscene language, when by making a graphic
description of a sexual act, and the offender knows or reasonably
should know that such obscene or graphic language is directed to, or
will be heard by, a minor. Lack of knowledge of age shall not
constitute a defense.

(5) Knowingly permit any telephone under his control to be
used for any purpose prohibited by this Section.

B. Any offense committed by use of a telephone as set forth
in this Section shall be deemed to have been committed at either the
place where the telephone call or calls originated or at the place
where the telephone call or calls were received.

C. Whoever violates the provisions of this Section shall be
fined not more than five hundred dollars, or imprisoned for not more
than six months, or both.

D. Upon second or subsequent offenses, the offender shall be
fined not more than five thousand dollars, or imprisoned with or
without hard labor for not more than two years, or both.

E. (Repealed.)

Not sure how it works in Ohio but good luck.

Hey girl, all those laws are fine but bottom line is, now you know that a restricted or private call is someone screwing with you, let it go, just dont answer.

----there is a way to make a it "restricted" from your phone when you call someone, and thats what they're doing. Is there a way that the police can find out who it is anyway to prove it was them?
( i know we should know this stuff but i just wanted to know from someone who's dealt with it before)

Ohio Revised Code

2917.21 Telecommunications harassment.

(A) No person shall knowingly make or cause to be made a telecommunication, or knowingly permit a telecommunication to be made from a telecommunications device under the person’s control, to another, if the caller does any of the following:
(1) Fails to identify the caller to the recipient of the telecommunication and makes the telecommunication with purpose to harass or abuse any person at the premises to which the telecommunication is made, whether or not actual communication takes place between the caller and a recipient;
(2) Describes, suggests, requests, or proposes that the caller, the recipient of the telecommunication, or any other person engage in sexual activity, and the recipient or another person at the premises to which the telecommunication is made has requested, in a previous telecommunication or in the immediate telecommunication, that the caller not make a telecommunication to the recipient or to the premises to which the telecommunication is made;
(3) During the telecommunication, violates section 2903.21 of the Revised Code;
(4) Knowingly states to the recipient of the telecommunication that the caller intends to cause damage to or destroy public or private property, and the recipient, any member of the recipient’s family, or any other person who resides at the premises to which the telecommunication is made owns, leases, resides, or works in, will at the time of the destruction or damaging be near or in, has the responsibility of protecting, or insures the property that will be destroyed or damaged;
(5) Knowingly makes the telecommunication to the recipient of the telecommunication, to another person at the premises to which the telecommunication is made, or to those premises, and the recipient or another person at those premises previously has told the caller not to make a telecommunication to those premises or to any persons at those premises.
(B) No person shall make or cause to be made a telecommunication, or permit a telecommunication to be made from a telecommunications device under the person’s control, with purpose to abuse, threaten, or harass another person.
(C)(1) Whoever violates this section is guilty of telecommunications harassment.
(2) A violation of division (A)(1), (2), (3), or (5) or (B) of this section is a misdemeanor of the first degree on a first offense and a felony of the fifth degree on each subsequent offense.

Yes, they can still be tracked.
if you speak to the local police department, they will give you a report #.
It is up to you to contact you local phone provider, land line, or cell phone company.
they will place a trace on your line,
remember this, in most cases, incoming, and outgoing calls are recorded, and documented.
this is usually placed on for 14 days, or 30 day increments.

When its all over usually the phone provider will send either you, or the Police agency all of the documents from the start date, to the end date.
Note: they may charge you for this service, but it is well worth it, if this is what you want to happen.
in most cases, a simple courtesy call from the officer usually does the trick.

I wouldnt, normally, but when the Millersburg Police Dept. calls me it comes up as restricted, and Im working on getting hired there.....so i cant ignore them......:(

They just called again. No reply.....i hung up after 30 sec. 1:36am.

Write down the date and times off all calls recieved like this.
this will help the officer when you take it to him.

You're going to have to make your own case. Go ahead and call the police (non-emergency) and get a report. Get the case number, and keep your own journal. Once you have a good amount (you or the officer's discretion) of calls listed, follow up with the report and ask that criminal charges be made.

I hope i can finally teach someone that immaturity can get you in trouble. EH HEH HEH

If it's legal in her state (ask the PD), then would her also recording all the calls as evidence, especially in case the idiots call back cussing at her, be benificial?

Of course some states have laws against recording unless both parties know about it - I guess she could tell them that she's recording it for evidence while they're cussing at her, and make it legal?? :D

Some answering machines have a conversation record button, or one of those little Sony DVR's placed next to the earpeice may work.

Aside from the phone issue....it also sounds as if you have been illegally evicted by your roomates.

You can go to small claims for the deposit money.

agreed with above and change the number.

only give your number out to a few that you trust.

I would do that, but ive found another apartment from the same landlord and she said she would transfer the lease and give me a deal on the rent for July too. :)

K-9 Max is right on the money. Keep logging the calls. And voicemail is a good thing. I can tell you if someone from the department calls and gets your voicemail, we''ll leave a message.
