    What would you have done?????

    Last night while on patrol, well sometimes you just get that feeling... As we pulled up behind a late model truck we ran the plate and it was just was expired (By 3 days), normally you would just let them go and give them the benifit of a doubt, you have a 10 day grace period for renewals..... But something does'nt feel right and we light him up and effect a stop.(if you want to know what we used for PC just PM me as to I will not post it here.) Now on to the stop..

    I learned ALOT last night...and watched the officer approach from the passenger side slightly touching the taillight and moving on to confront the driver..The 19 yr old young man was very polite and at first did not want to play (Tell the Truth) but with a little encouragement he started talking and cooperating. as he just left a friends house....Here is the list that we ended up with..

    19 years old male lives 3 miles away..with Grandmother and Grandfather.

    Driving Under the Influence
    Minor In Possion of Alcohol(Beer) Just one unopened beer..
    Posession of Marujuana (Couple roaches)
    Posession of Drug Paraphernalia (Two pot pipe , Small ones)

    In Texas if a Minor gets a MIP he will have to forfit his drivers license to the judge......


    What would you have done...I just wanna see what other officers would have done..

    First and most important......What time was it? Was it near the end of the tour?

    Second, what else is going on? Radio busy? Are other cops handling calls in your sector?

    Third, did any felons avoid getting collared while you are dicking around with some kid with beer?

    I am not being judgemental here (well, maybe a little).....

    arrest the kid...
    who owns the vehicle?? if its mom and pops only car and mom and dad have to go to work, I am not a huge fan on towing it and would have released it to one of them. (or grandparents) If it was the kids car.. its towed.
    end of shift i am taking the over time.

    he isnt a juvenile so he is going the whole ride here.

    let the state attorney change the charges or whatever later.

    It was at 6:32 in the afternoon.....very beginning of 12hr shift.

    ....rural part of county and nothing around....

    Was his uncles work truck..he was living with his grandparents


    Had a couple of calls holding....

    One other officer for the Southern sector (450 sq miles) only 4 officers covering 904 sq miles ..

    Felons getting away, nope....

    I'm not Offically a officer just yet, still got a ways to go, but I ride with these guys all the time and get to do things most would not get to do...its also just happens to be the dept. that I want to work for in the future..

    Just a piece of advice for you.

    I would limit how much "we" you have in the conversation then. Sure you were in the vehicle with him, however HE was doing the work. You will find that if you start talking like that around the department more frequently your chances at getting hired may get smaller, and it might be harder to find guys to ride along with.

    I had an auxilary guy ride with me once who started making the "we" remarks. He came out one last time and I made a decent felony arrest. After I got back from the jail he made a remark to someone on his cell phone about "his" first felony arrest. I dumped my clipboard on him and said, "good, finish up all this paperwork". His tune changed real quick.

    Alright I'll sum it all up, here is what happened..

    After calling his grandparents to come over to where we were at, and had a talk with them , It was clearly apparent what was going to happen to this kid, After grandma and grandpa saw what was on the hood of the car , grandpa almost rodeny kinged his ass, LOL!! Grandma was chewing some major ass..and told us that he recently lost his parents and had made some new bad freinds...and grandma and grandpa were not taking no shit from this kid..

    We made him pour the beer out, destroy both pipes and destroy the roaches he had on him....

    Released the truck to his grandpa which drove off in a VERY pissed mood at his grandson..

    Then wrote a MIP ticket for the possesion of the beer (which will get his liscense suspened) and released him to his grandmother to take home..

    I will say this, the kid was going through some serious times with the loss he was dealing with and we did'nt think making matters alot worse for him was the right thing to do to help the situtaion..so it was a MAJOR slap on the wrist, with a stern warning that we would be looking for him and would be checking back with the grandparents to see how things are going.. just think the kid needed a kick in the right direction..

    While some people may say that he should have been hammered to the fullest extent I will say that I don't see anything wrong with that. One thing that makes this job great is officer discretion.

    It could have been appropriately handled either way.

    I will add that I may have had a talk with the grandparents and told them to come talk to me when he is ready to give up his source for the dope. Surely that would have planted the bug in their ear to start working him on where he's getting the weed.

    Cops have discretion; those are all summonsable offenses here. Driving drunk, drugs... He's got problems. I don't know that charges are the wake up he needs.

    I've given breaks, and later arrested the kid. And I've given breaks where they person got the message. I wasn't there. The offenses were relatively minor. The cop there could assess a lot more than I can at two removes.

    The basis for discretion must be articulable, or the officer which you are riding with could very well be faced with some highly provocative questions from the defense counsel representing the next young person he finds in a similar situation, and who may not go home with grandparents from the scene.
