    Sec. 3. It is a Class B misdemeanor for a person to be in a public place or a place of public resort in a state of intoxication caused by the person's use of alcohol or a controlled substance (as defined in IC 35-48-1-9).

    Our detox won't take them if they're acting up. Or if someone is willing to "take care" of them (for example, the buddy whose house we're at breaking up the party) detox won't take them either. Or, usually the problem in the winter, detox is full with all the homeless bums BSing their way in for the night so they aren't accepting anyone anyways. Basically I can't use detox as a problem solver like I could the public intox statute in VA. They actually closed the detox center due to budget. Now it's literally a circus tent in the jail compound.
    The world would be much cleaner if blind people carried brooms instead of sticks.

    At communion, when the priest says "Body of Christ", I say "Thanks, I've been working out", then I grab the cracker and run back to my seat

    An amateur practices until he gets it right. A professional practices until he cant get it wrong.

    They've got us surrounded? Good. Now we can fire in any direction. Those bastards won't get away this time.

    In that case, I can understand your frustration. You're getting a first hand look at a decent idea poorly executed.

    We use detox as a problem solver all the time. If someone is acting up bad enough that detox won't take them, then I usually charge them with whatever's applicable. I can put them on a detox hold w/o/ charges at the jail, too, but that makes lots of extra work for the jailers so I'll usually bond them on something at that point.

    Our jail won't take misdemeanors without one of our supervisors contacting one of their supervisors and having it approved. It's frustrating as hell. All we can really do is cut them a ticket and tell them to go away. If they don't we have to tell them to go away again

    How does that factor in with liability for you guys? Over here if an officer makes contact with an intoxicated person and lets them go, the Officer can be held civilly liable for any action that person takes later (e.g. drives a car and wrecks, walks into a road and gets run over). So most agencies encourage their officers to take any intoxicated person they are called for to jail for that reason.
