    Supreme Court rules against buying guns for others

    A divided Supreme Court said yesterday the federal government may strictly enforce a law that prohibits straw purchases of guns intended for others, siding with gun control groups and the Obama administration.
    The court by a 5-4 vote upheld the conviction of Bruce James Abramski Jr., a former police officer in Virginia, who bought a Glock handgun for his uncle in Pennsylvania, hoping to get a discount on the sale. Because both men were eligible to own guns, Abramski claimed he had not run afoul of the law.

    But Justice Elena Kagan, writing for the court's liberals plus Justice Anthony Kennedy, said the government had good reason to prevent "straw purchasers" and insist that the person who buys a gun be the weapon's legitimate owner.

    Background checks of those buying guns keep them out of the hands of convicted felons and the mentally ill, Kagan said, and also allow law enforcement to trace guns used in crimes back to their purchaser.

    After reading a summary -- I've got issues with the ruling. I don't think this case was in the spirit of activities the restrictions on sales target, and by changing only one small detail (charge his uncle a buck over the price so that it's a resale instead of simple transfer), he'd have been legal. Or if it had been purchased as a gift... At the same time, we don't want people buying guns for folks that are evading the background check or other legal requirements of the purchase.

    Dumb case to push, and as a result, dumb case law was made.

    I agree. Punish everyone instead of the people who should be punished when buying guns for unauthorized people mentality.
