Mentally disabled man fatally shot by guard at HayesWednesday, June 06, 2007
(How about, Guard shoots Burglar who struggled during arrest?)
Police and school officials are investigating the fatal shooting early Tuesday of a 24-year-old mildly retarded man by a security guard at Birmingham's Hayes High School.
Authorities said it appeared that Alfonzo Turner broke into the school sometime before 3 a.m. Tuesday, where he was eating soup and chips he found in a filing cabinet until the alarm sounded, and he fled through a window.
School officials said Turner was shot and killed after a security guard's gun accidentally discharged during a struggle with the suspected intruder. Turner was shot once in the back.
Turner's family members, who gathered at his Woodlawn home Tuesday afternoon, said Turner was walking home from an aunt's house and often took a shortcut through the Hayes campus. They questioned police and school officials' accounts of the incident.
"Something's not right," said Turner's aunt, Denise Shoals, who has had legal custody of Turner since he was 3. "No gun just went off. It went off real good when he shot him."
Authorities have not identified the security officer who shot Turner. He has been placed on administrative leave pending separate investigations by school officials and police.
Regina Waller, Birmingham City Schools spokeswoman, said the officer was taking it hard. It is the first time anyone could recall a Birmingham school security officer being involved in a fatal shooting, she said.
Two school security officers were dispatched to the school at 505 43rd Street North at 3 a.m., after they were alerted to a break-in, Waller said.
When they arrived, they saw a man exiting the school through a window. As one of the officers was trying to handcuff the man, the suspect turned and tried to attack him, Waller said.
One of the officers had his gun drawn, and was able to get one handcuff on Turner. Turner, face down on the ground, used his free hand to strike out at the officer, authorities said.
They struggled, and the security guard's gun discharged one time. Turner was taken to UAB Hospital where he underwent surgery. He was pronounced dead at 5:50 a.m., said Jefferson County Chief Deputy Coroner Jay Glass.
Shoals said Turner had eaten dinner Monday night at another aunt's house near Hayes High. One of Turner's best friends told Shoals that he'd also eaten separately with Turner that night.
Shoals said she believes Turner, who has a 3-year-old daughter, was on his way home when he spotted the security officers and either hid or ran from them.
"My sister said that alarm goes off all the time," Shoals said.
She said she couldn't think of a reason Turner would have broken into the school.
"It's just ridiculous," she said. "There's nothing in Hayes to get."
She said Turner attended Hayes, where he took special education classes because he was "slow." He didn't graduate and received Social Security benefits for his mental disability.
Court records show Turner was arrested in March on drug and alcohol-related charges.
Shoals acknowledged that Turner had some trouble with the law, but said he often took the fall for his friends. "He couldn't think like the other kids," she said.
She said Turner weighed 120 pounds, and showed no signs of a struggle at the hospital.
"I could have handled him," she said, "so I know they could have handled him."

We dallied under
Vine maples and sapling alders
Searched for lady slippers
But instead
Found blackberry riots and
Desiccated branches
An old skid road
Brought ghost ferns and
Hollows filled with
Skunk cabbage
While waves wrapped
Intricate lacings of weeds
'Round mule spinners
His cyanotic eyes
Were hard enough to make
The sun turn tail and
Tender enough to attract me
To his world of illusion

Mentally disabled implies he's incapable of knowing right from wrong.
In which case I have to wonder...
Why was he out and about at 3am?
How did he manage to father a child?
Interesting manner of shortcuts too.
I think the Special Needs community should be raising cane with the media's choice of labeling him.Molly Weasley makes Chuck Norris eat his vegetables.

But that makes the police look like they are competent and doing their job- the media can't have that."If everyone is thinking alike, then someone isn't thinking." -Gen. George S. Patton
