Bar Fight...
So I went out with my best friend Holly, and we go have a drink (yes I only had one) and visited with each other at a local sports bar... as we are leaving i notice two guys walking towards us... we jump in my car and they stand behind me moving really slow... then all of a sudden guy number three walks out and one and two jump him... one and two jump in a car and take off... i follow at a safe distance till the deputies catch up... and in the end... everyone was let go...
if the guy had the crap beat out of him how come they didn't get arrested? Is it a mutual combat thing or a no victim no crime? (the victim refused treatment and refused to press charges)
Yawn... time for bed... had to "vent" about my night so I could sleep well....

I am not sure about the laws in Cal, but here for them to be arrested if the officers did not witness the incident it would have to be a felony or domestic violence.
But you're a deputy, you can't give me a ticket!

it was pretty bad... on the last blow the guy didn't get up... he got knocked out and was out for a good 3-5 minutes...
even if there are witnesses? I just found it strange... I know it is just how it works but man... if I got beat like that guy I would be pressing charges... he was torn up

It may have been a felony here depeding onthe extent of the injury, for an Assault 2nd charge they would have to have intended to cause serious physical injury

Best guess... The victim didn't want to press charges. There are only a very few cases where I'll go forward with a non-cooperative victim. There's no point in it if you're gonna end up in court and have to explain to the judge or prosecutor that your witness, the victim, didn't bother come to court...
It's hard to say with what you've written, but I'd probably have just advised him how he can get a warrant...

Yeah... I figured as much... as soon as I heard that the guy refused medical, he looked gross! Stupid people I suppose...
Well... I would like everyone to know that job security is still alive and well...and living in Rancho Cucamonga, CA apparently!
I know if someone waited outside a bar to jump me, I sure as hell would make them pay!
Oh well...

The last one I had the victim was pissed off and belligerent. When I tried to explain the process to him he said fuck it and would handle it himself. I told him he needed to a better job than he did this time and left.

Illily, in order to have a crime, you sometimes need to have a victim. If the victim isn't willing to press charges then they won't be willing to show up in court, which means the charges will get dropped anyway.
