    Georgia trooper loses taser suit.

    The federal appeals court in Atlanta ruled Wednesday against a Georgia state trooper who claims his spine was fractured by being shocked with a Taser during a training exercise.

    I could see mabe someone getting some sort of injury from falling, but not from the muscle contraction itself.

    You'd be surprised. Those injuries are one of the most common injuries associated with being tased in and of itself (not including falling). The muscles contract so hard that they can tear away from tendons, or simply tear. In rare cases, especially in someone who has a weakness in the bone, it can actually tense hard enough to cause a fracture.


    Could this trooper be trying to cash in? Possibly. Could he have had an unknown hairline fracture which was worsened? Possibly
    The world would be much cleaner if blind people carried brooms instead of sticks.

    Add in some imbalance in muscle development (strong back, weak abs -- very common), and I can see that happening.

    But I would need some solid evidence that the problem was CAUSED by the Taser, and not simply aggravated.

    On face value of the article above, a doctor testified that the injuries were result of the taser, however it was dismissed because the doctor couldn't be noted as an expert.

    IMO, where the trooper went wrong was suing taser. I definitely think that if he had back problems that we all have from wearing duty belts, and it seems that he definitely has fractures, and if it was proven by others at the class that he was in pain after the shock, he should be medically retired and get workers comp benefits. That I would agree with wholeheartedly as, again on it's face, it doesn't seem like he's trying to play the system. Suing taser for it, I don't agree with.

    However now I know exactly why taser has made the warning of these injuries part of their instructional class.

    Taser challenges almost every lawsuit brought against them. They don't just write a check to make someone go away, because if they admit defeat, it would ruin their company.

    The problem the trooper faced, according to the article, was simply a lack of expert testimoney. You can bet Taser International has a team of legal and medical professionals on standby where all this trooper has his is attorney and probably a family doctor. So, in reality, he doesn't stand a chance.

    It's not that this Trooper is lying or over-exaggerating. He didn't have enough to go to bat against a big company who handles these types of law suits day-in and day-out.

    All this Trooper knows is he got hit with a Taser and next thing he knows he's being told his back is broken. And a doctor tells him it was because of the Taser. I mean, what would you do?

    Could be any number of mitigating circumstances as well, as others have said. But I'm not going to tell a brother officer he's "full of shit" just because he wasn't legally prepared to face a Goliath.
