    Couple in Britain arrested for injuring burglars who broke into their home

    Andy Ferrie, 35, and his wife Tracey, 43, were arrested after calling police to their home in Welby, near Melton Mowbray, Leics, just after midnight on Sunday.

    Mr Ferrie, who owns his own mobile caravan and motorhome servicing business, had confronted four burglars, aged between 23 and 33, who broke into the cottage and fired a legally-owned shotgun at them, injuring two.

    He telephoned police immediately whilst one of the injured men called an ambulance. He was taken to hospital, where he along with three other men were arrested on suspicion of aggravated burglary.

    Mr and Mrs Ferrie were arrested at their home on suspicion of grievous bodily harm.

    There is more to this story.
    We would not arrest both people under the given circumstances.
    They may have been arrested, doesn't mean they will be charged. Such an incident will almost always result in the intial detention of someone in order that any interview becomes admissable in court later if required.
    However still makes me smile to think of a couple of burglars with shot in their arses. maybe they will succumb to lead poisoning.

    Not everyone whose arrested ends up in court.
    The arrest is on suspicion of an offence. It's the CPS, crown prosecution service, who decide if there is sufficent evidence to charge.
    For some straightforward charges, especiallly if guilt is admitted, then the police are allowed to make the charging decision.

    I understand not everyone who is arrested ends up in court. We even have a legal standard for investigatory detention, outlined in Terry vs. Ohio. We can hang on to you long enough to deduce we do or do not have probable cause when we have reasonable suspicion.

    We can book someone into jail under custodial arrest on probable cause, but to do so while never intending to reach that bar would be a civil rights issue. In other words, we cannot arrest on mere suspicion, but only the higher standard of probable cause.

    As I understand it from some British cops on a martial arts board , they have much broader authority to arrest then we do with much less standard of proof . Things we could basically detain someone for question at the scene , they can actually hook them for.

    Curious, were the offenders charged or did they slip away while we were discussing the actual victims? I'm strange like that, wanting to know if the predators are getting the same looking over as their prey.

    There's a life history of the victims being broadcast around the world, but the rights of the offender are being kept close. Interpol wouldn't bother ringing anyone named Holmes to try to track down these home invaders with the few available details to their identity.
