ATLANTA - A group of robbers in Atlanta picked the wrong victim.

Police say former Marine Thomas Autry fought off four attackers on Monday night with a pocket knife. They say he killed one and seriously wounded another.

Detective Danny Stephens said Autry was walking home from his waiter job when attackers armed with a shotgun and a pistol chased him. The detective said Autry pulled the knife out of his backpack when the group caught him.

Stephens said the 36-year-old’s “training kicked in and he knew what to do.” He kicked the shotgun out of one attacker’s hands and stabbed a 17-year-old girl who jumped on him, as well as a man who also attacked.

The suspects fled, but police said they found them at a hospital, where the girl was pronounced dead.

Stephens said they face robbery and aggravated assault charges and are suspected in other robberies over the past week. Autry will not be charged.

Umm, because he was attacked and did what he had to do to survive. I don't know how they do things Down Under, but here in the USA you have the right to protect yourself when attacked. They implied deadly force against him and the scumbags got the tables turned on them.

In much of the non-communist portions of the USA (Texas included, New York & Washington DC excluded probably) the "Reasonable Belief" that deadly deadly force is necessary to defend yourself against the use of deadly force is often enough. "Reasonable Belief" does not necessarily have to translate into "actual danger".

Also this was a robbery - I don't know what the Georgia laws have to say about it, but that would give him double justification in Texas to blow any of them away to stop the robbery (which can be just a little pain inflicted during the course of a theft) - I'm only paraphrasing from memory, so look it up. For Texas that'd be:

PS - It says robbery is "bodily injury" or "fear of imminent bodily injury" in the course of a theft, but if you look up "bodily injury" in the General Provisions - Definitions para 1.07, it defines bodily injury as "physical pain, illness, or any impairment of physical condition.". Ouch, she slapped me

And Aggrevated robbery would be robbery with a deadly weapon which the guy did, plus she was acting in concert so it was all one "transaction", and they were equally fair targets, probably. At least if I were on a jury, that's how I'd see it.

Where I live he probably would be charged..... with manslaughter
at a minimum. And have to spend $50,000 in legal fees to go
before a jury and have the charge thrown out.

In Texas my expection would be that he'd probably spend the night in his own bed, depending on the cops and DA - But as you say, he may be charged & have to bail himself out, and then face a grand jury and then go to trial.

But every step of the way would be another opportunity that it'd get thrown out.

Just from other accounts I've read about that appeared to be much less justified than this.
