Jury awards $2 million in lawnmower death lawsuit
by Denise Eck / WSLS NewsChannel 10
    Jun 14, 2006

    --------------------------------------------------------------------------------

Jurors say a lawnmower maker is responsible for the death of a 4-year-old boy.

Justin Simmons died in April 2004 after being run over by a lawnmower at his Daleville day care center.

Jurors decided the maker of the lawnmower, MTD, should pay Justin Simmons' family $2 million. That is a third of the $6 million the family sought.

Ron and Kristie Simmons said this case was not about money, but about getting safer lawnmowers.

I want the industry to understand there is a problem, children are being run over, and they need to fix the problem,” said juror Theresa Reed. “They have recalls on vehicles. Have recalls on riding lawn mowers. Fix it.”

But John Fitzpatrick, attorney for MTD, continues to believe the fault lies with Orville Reedy, the man mowing the lawn who hit Justin.

“It is absolute absurdity that a man would drive a power mower with a 4-year-old in the yard, back up without looking, and blame the mower,” he said. “What has happened to personal responsibility and common sense in this country? I don't know.

When this case began, the Simmons family was also suing the Reedys. Earlier this week the family dropped that case.

Fitzpatrick said MTD planned to appeal.

This was a terrible tragedy. Very sad from every aspect. But WTF is the jury trying to prove? This is why we are a sue happy society.

That would be like suing Ford for a drunk driving death. Damn people, get a grip.

more like... shooting the children, then calling the parents and telling them the gun came alive and went on a rampage... all by itself.

Actually, he's suing the United States Government, not glock. It was apparently the government who pulled the triger and shot him in front of a room full of kids while a parent video taped.

I am suing Estwing cuz I just hit my finger with the hammer.
    And Shepards we shall be,
for thee, My Lord, for thee,
Power hath descended forth from Thy hand,
That our feet may swiftly carry out Thy Command.
So we shall flow a river forth to Thee
And teeming with souls will it ever be.
