I think you're dealing with different statutes, depending on how far things go.

First, the "soliciting a minor on the internet" requires that you believe the person who you are communicating with is a minor.

So if you believe the person is a minor and go somewhere to meet them, you are outside the law. You've been clear that is not what you're doing.

Second, if you get someone that claims to be over 18, you meet them and begin a sexual relationship, and then find out they are really underage, then you have committed a sex crime. In the sex crime laws involving minors, it typically doesn't matter whether or not you "knew" how old they were.

So it is really two different types of crime. At the internet level, you have to be proven that you "believed" the person was a minor and still solicited sex with him or her. But once personal sexual contact occurs, they state only needs to prove that the person "was underage" at the time of the contact; it really doesn't matter what you knew or believed.

I hope this helps. Oh, by the way, if you agree to meet with someone that says they are of age, meet them at a place where they'd be IDed like a bar. That might help you with the age thing. Most importantly for your safety legally or otherwise, do a lot of research and move slowly with relationship you are forming on line. This will be better if you are looking for a relationship rather than a "hook-up" anyway. There are no advantages to rushing in with anyone you meet; especially over the internet

And I am insistent on deleting what my original question was. That question was can I get in trouble if I am hitting on boys on myspace that tell me they are 18 and then I find out that they are not later. I like boys and I like going to law enforcement websites to get answers for the legal morass that my moral issues create.
