Citation without observation
Hello everyone, I'm new here and I'm sure this is a repost.
I got a ticket for passing in the HOV lane. The officer did not see me pass anyone - a car stopped and told him that I did then he caught up to me and gave me a ticket. He was a real jerk about it too. First words out of his mouth were "Do you always pass in the HOV lane?". I refused to answer and he got mad and threatened to tow my vehicle and put me in jail.
I'm a safe driver and haven't gotten any tickets in about 5-6 years. Personally I think this is BS. This means that anyone can stop a cop and tell them that you did something and you get a ticket for it????

Not sure about where you are, but in FL a citation will not hold up in court unless we witness the violation. For example... we have a department policy that states we will write citations for the person found to be at fault in an accident. (i.e. witness said you ran the red light) in court the judge will ask the officer if he/she witnessed the violation. As soon as they say no, the citation is dismissed.
In law enforcement, the customer is ALWAYS wrong.
In God we trust. Everyone else is run through NCIC.

Either way, at least up here it works like this, a witness has to sign the ticket and when the officer goes to court the judge will toss it if the witness isn't there. I would only pull someone over that a "hand waiver" pointed out to me if it involved the dude being reckelss or drunk.

A signed witness statement is about all the probable cause I need at the minimum...if they're lying, then it's their ass for false reporting or perjury.

Guys this guy is a troll. He is not from Texas, and he didn't get a citation for passing in the HOV lane. He's really from Commifornia and he got a non-traffic citation for selling candy without a business license. Don't believe me I have the pic to prove it.

What the heck is going on in here? All I did was ask for a few opinions on something that happened to me and I get called names and insulted??? I hope some of you guys aren't really law enforcement.
BTW - I didn't mouth off to that police officer that day, all I did was refuse to answer his trick question.
