    CHP Recommends Charges for Singer Brandy

    Police want to charge Brandy for accident

    CHP recommends vehicular manslaughter charge for starting fatal crash

    LOS ANGELES - The California Highway Patrol recommended Monday that actress-singer Brandy be charged with misdemeanor vehicular manslaughter in a freeway crash that killed a woman motorist last month, a city attorney’s spokesman told The Associated Press.

    The CHP referred the matter to the city attorney’s office for review, said spokesman Nick Velasquez.

    “The office is currently reviewing the case and determining whether the evidence warrants the filing of a misdemeanor charge of vehicular manslaughter,” Velasquez said.

    A message seeking comment from Brandy’s publicist, Courtney Barnes, was not immediately returned.

    The charge carries a maximum sentence of one year in county jail and a $1,000 fine, Velasquez said.

    Prosecutors couldn’t say when they would make a decision about whether to bring a case. If charged, Brandy wouldn’t necessarily have to appear in court and could have her lawyer enter a plea, Velasquez said.

    Brandy, whose real name is Brandy Norwood, has publicly expressed condolences to the victim’s family, Barnes said last week. Barnes also has said Brandy wasn’t under the influence of drugs or alcohol at the time of the crash.

    Brandy, 27, was driving a Land Rover on Interstate 405 on Dec. 30 when traffic slowed and her vehicle struck the back of Honda driven by Awatef Aboudihaj, 38, according to a CHP report.

    Aboudihaj’s car hit another vehicle, slid sideways into the center divider and was then hit by another car, the report said. Aboudihaj, a Los Angeles waitress, died at a hospital from blunt-force injuries, according to the coroner’s office.

    Bill Sayed, an attorney for Aboudihaj’s husband, said he supported the CHP’s recommendation.

    Brandy, who earned a Grammy in 1999, has made five albums. She began her recording career at 14 and acted for film and television, starring on the sitcom “Moesha” from 1996-2001 and most recently as a judge for NBC’s “America’s Got Talent.”

    n. the crime of causing the death of a human being due to illegal driving of an automobile, including gross negligence, drunk driving, reckless driving or speeding. Vehicular manslaughter can be charged as a misdemeanor (minor crime with a maximum punishment of a year in county jail or only a fine) or a felony (punishable by a term in state prison) depending on the circumstances. Gross negligence or driving a few miles over the speed limit might be charged as a misdemeanor, but drunk driving resulting in a fatality is most likely treated as a felony. Death of a passenger, including a loved one or friend, can be vehicular manslaughter if due to illegal driving.

    Ok, I give up - I still don't know who she is.

    I just keep hearing that old 1970's song "Brandy, you're a fine girl"... But I guess that ain't her

    I looked in the Penal Code, and Negligent Homicide in Texas is a "State Jail" Felony (not much more than a Misdemeanor - 2 years max)... To get to be a real Felony, it has to be at least Reckless. I forget whether being in a vehicle makes any difference, but I don't think so, really.

    Nope, not the one. She's actually a decent celeberity if there is such a thing now a days, but because she is a celebrity she will probably not be charged.

    Looking Glass's one and only hit. I heard a story about it once that went they didn't like the song and played it as a gag in their act. It became popular locally, they cut a single and the rest is Billboard history. (Similar to Radiohead getting famous after the guitarist tried to ruin "Creep" during the session)

    As for this other Brandy - I've heard of her. Doesn't really matter though.

    This is a part of law I've never understood. Example : Some chick rearended me (I'd quite foolishly stopped at a red light) and since I was in my pickup and she in a Pontiac tin box I got a bent bumper and she got a ticket and a totaled car. Later I got a check from her insurance company. Reverse the roles there and she likely gets hurt or killed - should I be jailed because I drive a bigger vehicle in that case?

    Same action, different result = different penalty.
    That never has made much sense to me, but I'm open to having it explained. I seriously don't get that, especially with accidental stuff.

    Not really sure why a bad shot should get off lighter than a dead shot either if both did the same action (point, shoot to kill) with a different result. Guess I'm an intent sort.

    From all accounts I've heard so far, she was going the speed limit, and not under the influence.

    She did not slow/stop in time to avoid the collision...which means she was distracted *cough* cell phone *cough*

    The woman died of blunt force trauma, which suggests she was possibly not belted in properly?

    I think it is just sad.....it was an ACCIDENT. I mean, shit happens and you take a chance when you get into a vehicle. If it is proven she was going the speed limit, no drugs/alcohol involved, and traffic suddenly stopped and she hit the poor lady, I don't think she should have jail time. Traffic in LA (CA) is a BITCH. Anyone who drives here knows that. They are called ACCIDENTS for a reason. Just sucks all around.

    I was looking for circumstances that warranted charges against her. So either there are none or they werent listed in the article.

    Sounds like a shitty situation to be in.

    Years ago when she was more popular my parents actually met her on a plane they took together. They ended up chatting with her for a few minutes and my parents said she was actually very friendly and nice! I feel a little bad for her...

    I was just taking a guess at any number of distractions that have caused accidents.

    I was really surprised when Andrew Luster went AWOL. With all the money from his family's Max Factor cosmetics, all he had to do was throw some of those millions around and he too would have walked.

    A coalition of black community leaders urged City Attorney Rocky Delgadillo to reject the CHP's recommendation that Brandy be charged with misdemeanor vehicular manslaughter.
    "This was a tragic accident," said Najee Ali, leader of Project Islamic HOPE, who organized today's news conference. "Our coalition feels that the CHP is using Brandy as a political trophy and their recommendation is unfairly targeting her for prosecution because of her celebrity."

    As someone who was driving in a double fatality accident, I can personally attest to the fact that she's already going through a hugh guilt trip. From the accounts I read, there was no negligence: It was an accident. Of course the fact that she's rich and famous has Ambulance chaser lawyers licking their lips.
