SAN FRANCISCO (Reuters) - A man who intentionally spat at another can be charged with criminal assault, a U.S. appeals court ruled on Wednesday.
Jeffrey Lewellyn was sentenced to two years probation and 50 hours of community service after he spat in 2004 at a patient who swore at him on the grounds of a Veterans Administration Medical Center in Walla Walla, Washington.
He appealed the conviction, arguing that spitting did not constitute an assault, but the U.S. 9th Circuit Court of Appeals disagreed.
"Intentionally spitting on another person is an offensive touching that rises to the level of simple assault," the three-judge panel wrote.

i recently locked a guy up for spitting at/on me, i moved when he spit and only a tiny bit hit me. i described the incident in court paperwork as "a drop of spit approximately the size of a pea landed on my uniform pants" and the judge gave the guy 3 years.
i was very surprised, but the guy did have a lengthy recordin the warriors code there's no surrender, though his body says stop, his spirit cries...NEVER. deep in our souls, a quiet ember, knows its you against you, its the paradox that drives us all. its a battle of wills, in the heat of attack, its the passion that kills, and victory is yours alone.

I agree it should be.Been on the recieving end several times during my jailor days,a tazer would have been a pleasure for me.
I feel its ok to burn the flag as long as u wrap yourself in it first.
