Angry A&M Female Student's Body Cooked On Grill

SICK S.O.B.!!! - Even worse, this probably isn't a Death Penality case unless they can come up with a felony charge in addition to the murder charge

    Police Say Ex-Boyfriend Confessed

    POSTED: 9:14 am CDT March 25, 2007

HOUSTON -- A 19-year-old Texas A&M University student was killed by her ex-boyfriend, who then dismembered and burned her body on a patio grill, authorities said Saturday.

Investigators say Timothy Wayne Shepherd, 27, confessed Wednesday to strangling Tynesha Stewart because he was angry she had begun a new relationship. Shepherd, who is charged with murder, is being held on $250,000 bond.

"We have determined through this investigation that the defendant dismembered Tynesha Stewart and ... he burned the body parts," Harris County Sheriff Tommy Thomas said. "There are no remaining body parts."

The announcement was the latest in a debate that has raged since Thursday in the Houston area, when authorities said they would not search for Stewart's body because there was little chance of success.

Officials first thought that the body had been disposed in a large commercial trash bin that had since been emptied. Authorities believed her remains were scattered in several overflowing landfills, and that the search would be expensive and nearly impossible.

The decision angered family and friends, and complaints from activists and lawmakers prompted Thomas to get emergency approval to spend up to $500,000 for a search. But the search never began.

Thomas said he knew, but could not disclose, that there were no body parts to find. He said investigators were unable to release that information to the public or to Stewart's family because of the investigation. Stewart's family has since been advised, and understands why there will be no search, Thomas said.

Stewart, a college freshman from Houston, was last seen with Shepherd on March 15 while she was home for spring break visiting her mother. Friends have said Stewart and Shepherd quit dating at the beginning of this school year.

Shepherd's attorney, Chip Lewis, has not returned calls for comment. A call seeking comment was made to Stewart's mother Saturday night, but there was no way to leave a message. Thomas said the family had asked for privacy and would not respond to media calls.

Authorities did not give any more details about how they believe the slaying occurred, but said nothing remains of Stewart. Although human remains generally require extremely high temperatures to destroy, Thomas would not discuss how he believed the body could be burned to nothing.

I don't think so... If they can prove that he robbed her or burglarized her house, then maybe they can seek the death penality, but you can't get death in Texas just for murder, unless it's a protected person like a child, police officer, etc.

Hopefully he stole something in the process so maybe they can get him for murder in the comission of a robbery, or something fryable like that. But I still doubt it, because any theft was probably an afterthought (thus a separate transaction).

Can any of you guys think of a way the state can fry him???

I bet the BBQ grill thing only counts as improper disposal of a body, or destruction of evidence after the fact.

Too bad someone didn't witness it while it was happening - then they could have shot the SOB and solved the problem.

Hmmmm....what are the DV laws in Texas? Because they were once in a relationship, it would qualify as DV violence in California - always ups the charges.

Once again, reality rivals fiction. As the parent of 2 daughters, I can only imagine the pain her parents must be enduring. There is no punishment which is enough for this.

Poor girl was the neice of a Dallas Cowboy cornerback. Aaron Glenn has also played for the Jets and Texans after he graduated from Texas A&M.

Article said she was last see with him. If he confessed to holding her against her will or kidapping her prior to killing her then they could go for the death penalty. Not enough info in article to say if she was there on her own free will or not.

Doesn't Texas have any kind of abuse of corpse statute?

    It's either a C or B Felony in Oregon. In this case, it'd be a B Felony.

ORS 166.087 Abuse of corpse in the first degree. (1) A person commits the crime of abuse of corpse in the first degree if the person:

    (a) Engages in sexual activity with a corpse or involving a corpse; or

    (b) Dismembers, mutilates, cuts or strikes a corpse.

    (2) Abuse of corpse in the first degree is a Class B felony. [1993 c.294 §2]

That's a good point... Aggravated kidnapping works for me... I'd vote to convict if he "abducted her" by forcing her to move a millimeter from where she didn't want to go.

The problem with the corpse statutes is that's something he did after the murder, not during the murder (hopefully she wasn't alive at that point)... I'm sure they could charge him with that too, but because it wasn't done at the same time, I doubt that it would get him death. Unless I was on the jury

HOUSTON, Texas (AP) -- For at least two days, neighbors at a city apartment complex noticed an acrid aroma, black smoke and leaping flames coming from two barbecue grills on the balcony of a second-floor apartment.

What, neighbors at the Red Oak Place apartments wondered, was going on in the unit where 27-year-old Timothy Wayne Shepherd lived? What was he burning at all hours, for days at a time?

    The answer turned their stomachs.

According to law enforcement officials, Shepherd dismembered, and then burned the body of his former girlfriend, Tynesha Stewart, a 19-year-old Texas A&M University student. Nothing remains of Stewart's body, Harris County Sheriff Tommy Thomas said at a press conference Saturday.

"I just don't know what to think about it," said Louis Evans, whose balcony faces Shepherd's in the quiet tree-lined enclave in northern Houston. "I thought he was a nice normal person. I guess you never know what your neighbors are doing."

Authorities said Shepherd has confessed to strangling and dismembering Stewart, a college freshman who was home on spring break, because he was angry that she had started a new relationship.

Officials first thought Shepherd had disposed of her remains in a large commercial trash bin that had since been emptied, launching an intense debate in the area about whether the Sheriff's Department should conduct a massive and expensive search of area landfills for Stewart's remains.

Stewart was last seen March 15 and was reported missing March 19. The next day the Harris County Sheriff's Office homicide division launched its investigation.

On March 16, neighbors said they first noticed the unusual activity -- and the unpleasant odor -- on Shepherd's balcony.

"The smell was awful," said Evans, who also became alarmed after seeing a blaze shoot out from the grills. "I was wondering: What is he burning? Not cooking, but burning. There is a difference."

At times, Evans said, the flames from the grills leapt dangerously close to the roof of the balcony. Evans says he called 911, but when firefighters arrived, the flames had calmed and Shepherd assured them everything was under control.

A leasing agent at the apartment complex also noticed the thick dark smoke and the intense flames and asked Shepherd what he was doing, Evans said.

Another neighbor, 18-year-old James Hebert, told The Houston Chronicle that he often cooked out with Shepherd, and even left his grill at Shepherd's apartment. When he wasn't invited over, he asked his neighbor what was going on. Shepherd replied that he was cooking for a wedding, the newspaper said.

Dionne Whitaker, 31, who lives in the complex, said she saw Shepherd carry the grill and smoker to a garbage bin a day or so later, the newspaper said.

Human remains generally require extremely high temperatures to destroy, and authorities have not said how it is possible that Stewart's remains could be completely burned on a patio grill.

"This certainly turned out to be one of the most heinous crimes I've ever seen in my 38 years (in law enforcement)," Thomas, the sheriff, said Saturday.

Shepherd, who is charged with murder, is being held on $250,000 bond in the Harris County Jail. Telephone message left with his attorney, Chip Lewis, were not immediately returned. On Sunday, the door to Shepherd's apartment was covered with plywood boards.

    TxCharlie....

My past experience with Harris County, was they don't stack charges, just go with the most serious offense. Maybe that's changed in the last 14 years or so.

That being said....don't they have "special circumstances" in Texas? The elements of kidnapping, and domestic violence would certainly qualify for that. I'd say the DA could "suggest" torture as well....since there is no body to prove or disprove...but his behavior would lead one to believe he was capable.

Hopefully so! Maybe they'll give us some updates on it after the DA decides what to do.
