    Prosecutors, Cline clash on Abbate's lesser charge

    Stung by suggestions that police helped an off-duty cop by charging him with a misdemeanor instead of a felony in the videotaped beating of a female bartender, Chicago Police Supt. Phil Cline said Friday that prosecutors saw the tape and agreed to the lesser charge.

    But a spokesman for Cook County's prosecutors released a timeline that contradicted Cline, saying two assistant state's attorneys reviewed the tape three days after the Feb. 19 beating and told police "we need to investigate further before charging."

    John Gorman, a spokesman for Cook County State's Attorney Dick Devine, said prosecutors' first charging decision came March 20 when they moved to upgrade the misdemeanor to a felony for aggravated battery.

    "This is our version of what happened," Gorman said.

    The dueling timelines emerged after Cline made his comments Friday in a taping of WBBM-AM's "At Issue" show.

    Two days after the attack at Jesse's ShortStop Inn, the police Office of Professional Standards reviewed the tape of Officer Anthony Abbate kicking and punching bartender Karolina Obrycka after she refused to serve him another drink, Cline said. The next day, he said, the tape was shown to an assistant state's attorney and his supervisor.

    "At that time the state's attorney's office felt that because she had no injuries that required hospitalization that it fell under a simple battery," Cline said on "At Issue."

    Police tried to arrest Abbate, but he checked himself in to a medical facility. When he left the facility, his lawyer surrendered Abbate to police and he was arrested March 14 and charged with misdemeanor battery. The department already had stripped him of his police powers and moved to fire him, Cline said.

    "Several days later, the state's attorney's office recontacted us and said they found a statute they felt would be able to be used under the [felony] aggravated battery statute," Cline said. "He was re-arrested on that."

    Prosecutors charged Abbate with a felony on March 20, the same day WFLD-Channel 32 first publicly aired the tape that shocked the country.

    Cline said he hopes a new policy will improve how authorities handle cases involving cops suspected of crimes. Police will meet with prosecutors within 48 hours of an officer being accused of serious criminal behavior. If prosecutors believe there is a strong case against the officers, they will be immediately stripped of their police powers.

    "I met with Dick Devine the other day and he agreed to it," Cline said.

    Police spokeswoman Monique Bond said the department wanted to release the videotape of another beating involving six officers attacking four businessmen in a West Loop bar in December, but the "state's attorney asked us not to so we would not compromise the investigation. We will respect their request."

    The six officers, who have been stripped of their police powers, allegedly attacked the men after one of them poked fun at an officer crying over his recently deceased father, sources said.

    Some of you may not know this but we have a felony review in Crook County. All the ASA'a in Felony Review are new, useless and have no balls. It is nearly impossible to get Felony charges approved on a stolen motor vehicle, the go with the Misdemanor charge of Crimminal Trespass to Vehicle. A guy gets stabbed 23 times (and lives), they don't call that attempt murder, thats Aggravated Battery. Got someone that robbed someone? It wasn't enough money so it is just simple theft. Our felony review system sucks nutz. I think this guy is a major piece of shit and should be fired, but if I can't get charges for agg batt for the gangbanger on the street what the fuck makes it right for them to charge a po with it?
