Man Gets 100 Years for Child Porn

A Bloomington man who used two girls to create pornography that he sold on the Internet has been sentenced to 100 years in prison.

David Andrew Turner, 41, also collected at least 5,000 sexual photos and videos of other children.

Susan W. Brooks, U.S. attorney for the Southern District, which includes two-thirds of the state, said prosecutors wanted to ensure that Turner would never be free to prey upon children again.

"This is one of the most egregious cases that our office has ever seen,'' she said.

The sentence was the longest ever meted out for such a crime in the Southern District. Turner must serve at least 85 years of that sentence under federal guidelines.

The two assistant U.S. attorneys who prepared the case, Gayle L. Helart and Steven D. DeBrota, have prosecuted about 125 child exploitation cases. Turner was sentenced Tuesday after a 2½-hour hearing in Indianapolis. He is being held at the Marion County Jail until the federal Bureau of Prisons determines where he will serve his sentence.

Turner pleaded guilty in August, but only after both victims had testified at his trial. The girls, identified only as Jane Doe and Mary Doe in court documents, were 12 to 15 years old during the three years Turner used them to create pornography -- from September 2001 to November 2004.

In sentencing Turner, prosecutors said U.S. District Judge David F. Hamilton considered that the defendant had put his victims through the ordeal of testifying before pleading guilty.

One of the girls is a close relative of Turner's, Brooks said, and the other was essentially homeless and viewed Turner as a father figure.

"He got them drunk. He got them high,'' Brooks said. On some occasions, the girls were so affected by drugs and alcohol when Turner photographed or videotaped them, DeBrota said, that they had no recollection of the events.
The investigation was started by the Bloomington Police Department, which collaborated with the FBI because Turner posted -- and sold -- pornographic images via the Internet. Investigators quit counting when they found 5,000 images. They believe Turner had several thousand more.

Brooks said the investigation showed that Turner, who was unemployed, was receiving about $1,000 a month from people who paid to get pornography from him.

In addition, local authorities are continuing to investigate a man photographed having sexual contact with the two girls. He is identified only as "John Doe, a friend and drinking buddy," in court documents. Brooks declined to elaborate on that investigation.

In court documents asking for the maximum penalty for Turner, prosecutors said one of the girls "has suffered from substantial drug and alcohol dependency problems'' and "has been robbed of the right to grow up free from the malicious interference of adults in her adolescent development.''
However, Brooks said, both girls now are in safe environments and doing better.

There's no question about the message the sentence sends, Brooks said.
"People who possess this type of trash,'' she said, "ought to think about spending the rest of their lives behind bars.''
