A case of mistaken identity led to a wild ride for a family visiting Central Florida on Thursday.
Seminole County sheriff's deputies chased down a car they thought was involved in a crime and even placed stop sticks to stop the vehicle.
Authorities said they were pursuing a silver Ford Mustang that was driving out of control on county streets, and around 1:45 a.m., deputies thought they saw the car entering state Road 417.
Officials said the deputies sped ahead of the car and placed some stop sticks.
The car that was stopped was a silver Dodge Charger.
A driver and passenger were handcuffed.
After talking to them and checking their records, authorities said they realized they had the wrong car.
"It was real wrong. If I can get a lawsuit, we're going to sue," victim Calvin Bryant said.
"I was very, very scared. They pulled me out of the car. He immediately handcuffed me. He didn't give me any explanation. He didn't tell me anything. The only thing I was thinking about was that my son was in the back seat of the car," victim Kimberly Paige said.
"Unfortunately, these things do happen. They've happened before, and they probably will happen again, but we still feel strongly that it's a much safer method of trying to apprehend criminals than chasing them at high speeds around the county," Seminole County Sheriff's Office Lt. Beary Smith said.
The sheriff's office issued an apology to the family and got them a rental car.
They also agreed to pay for all of the damages to their Dodge Charger.
The damages are being paid for and they're getting a great story out of it. The rest falls under the category of "shit happens."\\` ` ` ` < ` )___/\

Shit... Yeah, they screwed up. They sorted it out, realized it, and manned up and did the right thing. Fixed the car, got the folks back on their way in a rental.
And now the people are bitching.
Fucking assholes. Then people wonder why so many agencies and supervisors start doing the "No comment; under investigation" tap dance rather than simply fixing it when something goes wrong.

There have been lawsuits in the past for when officers entered the wrong apartment on search warrants. If I remember the people sued, but it got thrown out. The court said as long as the officers honestly believed that this was a the right apartment and then they were protected from liablity.

Besides Mistaken identity, what is he and his family the victims of. The article didn't say anything about them being mistreated or abused, so whats the suit for. Mistaken identity happens on a daily basis you just don't hear about it. Now, its not everyday that someone gets there car spiked because of it but it does happen fairly often. This guy is seeing dollar signs and trying to get a quick buck. I have gotten people out of cars at gun point only to find out that it wasn't the vehicle but it was one that matched the description or was similar in body style, yes at first they are pretty pissed off but after a good explination of why it happened they were for the most part understanding with a better safe then sorry attitude. But then again there is always that one person that feels that they are being violated and would rather see us do nothing and let the vehicle we are looking for do something to seriously hurt or kill someone just so they could push the blame on us for not doing anything.

More than likely, the department's insurance company will offer a settlement to shut the guy up and if he's smart he'll take it.

Hey, I agree that the guy has every right to be royally pissed off.
But, c'mon... They made it right. How far are they supposed to go?
I could understand the lawsuit if the PD hadn't fixed the car, or if it hadn't been sorted out at the scene. But what more can they do? I don't know why they got the wrong car... but how many times have you responded to a report of a "green Civic" only to find a green Tercel or something like that? They were on the lookout for a silver car, I presume moving fast down that road. They stopped a silver car. When they realized they screwed up, they got the folks uncuffed, on their way, and took care of the car. Like I said, that's why so many people start doing the "no comment; investigation is ongoing" dance rather than fix the situation.

JKS: I agree completely. My post was more in response to those who made it sound like the cops did nothing wrong. We all make mistakes. As far as making it right- isn't that up to the victim? I'm not saying the guy deserves the amount of money is undoubtedly going to ask for, but I view my time as valueable, and if something like that happened to me, I'd expect some type of compensation. Like I said, I'm sure this guy is going to suckle this on all 4 teats, but they should at least make some kind of offer- and I'm sure they will.

There's no way to give someone time back, and unlike a store or business, few chiefs even have the ability to write someone a check.
This is basically just a "de-arrest" situation. You realize you hooked someone you shouldn't have (close match on a warrant hit, but fingerprints rule 'em out or they failed SFSTs, refused a field breath test, and blew a low BAC, with no indications to support DUID are the most common examples I can think of), you unhook 'em fast, you eat some crow, and do all you can to make them whole and get them on their way. If the chief wants to do more -- or feels more should be done -- he's got more ability than a field supervisor.
I don't see any indication in this one article that the victim (and they are victims!) did anything to try to work it out with the PD first... he just sued 'em. Or at least that's how it reads.
