I'm leaning toward thinking that guy is a jackass...you don't shoot someone for breaking into a neighbor's house. you get a good description, get a direction of travel and stay on the line. Have fun getting sued by the dead burglar's family.

All kinds of stupid involved in that. While the criminals deserve whatever happens to them when they knowingly step into someone's home, the guy with the shotgun made a very poor judgement call in my opinion. Had he shot an officer in plain clothes it would have been a real tragedy.

Plain clothes officer, friend of the neighbors, family of the neighbors, service people, who knows.
He even said he doesn't know the neighbors.
In addition to that, he has no reason to suspect the neighbors were home, or any reason to believe the burglars were armed (he did say they had a crowbar, but it was used as a burglary tool..soo....), meaning he has no reason to believe someone was in immediate danger of death or serious bodily injury.

Yeah - people who let their emotions overpower their common sense scare me. You could tell he realized it was a bad idea as soon as he got back on the phone. Sounded terrified.

I've taken lot's of calls where someone thought their neighbors house was being broken into by strangers.
Some time's it's been valid, but many times it's been the house-sitter, the new owner, the former owner, the yard guy, the housekeeper, the kids, and any number of people with a legitimate reason to be there.
I've also locked myself out the house before, and I've had to find another way in, usually through the back gate or garage.Molly Weasley makes Chuck Norris eat his vegetables.

..Wow… Pretty amazing clip & 911 call.
He did what he wanted to do – despite sound advice to the contrary as he did so.
That’s what leaps out at me above all. He sure can’t argue ‘no other or better course of action occurred to me.’
It was calmly, clearly, explicitly articulated in his ear at the critical moment, which he-himself acknowledged. An eight year old would have understood not only the instruction, but the reasoning behind the instruction which was given every-bit as clearly & succinctly.
The ending was totally unnecessary.
To underscore how obvious that is, by the time he got back inside and picked up the phone again, the cops were on the scene.
Paraphrasing John Brunell: ‘The only thing worse than an idiot is an idiot with a plan.’
I don’t know whether that guy is an idiot or not, but that was intransigent bad judgment.

First of all i believe he said "Move, your dead" that was fair warning not to move i think. I dont agree with some responses. The 70 year old guy who never has had a criminal record was asked by his neighbor to watch their house. It is my understanding that in Texas you have the right to protect your person and property. The guy wasnt shot in the street he was shot in the this guys yard while these two guys were coming through his fence. Yes you could here him work himself up in the tape but when he made the decision to go out in his own yard and two guys that just burglarized a house came through the fence and into his yard and right infront of him. There are alot of people in this country that are tired of crime, tired of the justice system and there will be more acts of people doing things on their own. The justice system is pissing alot of people off not just cops that arrest criminals who are back out on the street before the cop has the paperwork done. I dont think that this guy will be convicted of any crime in Texas and I believe that this should be a wake up call for law makers, judges and attorneys that people are tired of crime in their neighborhoods.

That dispatcher TOLD him to stay inside!! It was NOT his home...if it was his home understandable.. but it wasn't his house... Property is property... his life would not have been in danger if he would have stayed inside as he was advised to do...
People like that scare me...
He deserves to be punished to the fullest extent of the law.
I would be curious to know the value of the items they left the house with...

Assuming he shot 2 residential burglars I say give the man a medal. He can live next to me anytime!
I don't know Texas law, if he is screwed or what?!? Best wishes to the armed citizen.
Residential burglars scare me. A few years ago in Vista (SDSO) we had a brutal burglary / rape / murder of a middle class female in a nice neighborhood. The Deputies caught the guy as he was fleeing the house.

Call me bloodthirsty, bitter or whatever; but I have zero problem with burglars being killed in cold blood. I don't care if you catch them, put them on a butcher's hook at take your time with them. Someone who's willing to go into a person's home, regardless if there's people present or not are some of the scumiest cocksuckers on the face of the earth, and it's only by severe punishments it might start being known that commiting residential burglary is a bad idea.
I just wish the old guy would have STFU and did what he had to do.
