NEW ORLEANS -- The strange tale of a local robbery suspect who took refuge at the district attorney’s house became even stranger Wednesday night when officials revealed he was unintentionally let out of jail.A Sheriff’s Department spokeswoman confirmed that Elton Phillips was released from jail on Dec. 21 due to a clerical error. Officials said they misread the word “recuse” on a form, thinking it said “refuse” – as in refusal to press charges -- and let Phillips walk out of the maximum-security wing of Orleans Parish Prison.According to a Sheriff’s Department spokeswoman, the district attorney’s office failed to notify the Sheriff that Phillips should be held after former District Attorney Eddie Jordan recused himself.Jordan recused himself from Phillips’ case after Phillips took refuge at Jordan’s house following a car wreck. Jordan’s girlfriend, Cheri Robinson, later confirmed that she knew Phillips and was friends with his family.Police said Phillips is also suspected of robbing a person at gunpoint at a gas station on Gen. Degaulle Drive, taking cash, jewelry and a cell phone from the victim.
