On Monday, Albemarle police released dash cam video from a November accident in downtown Charlottesville. An officer hit a disabled pedestrian with his police cruiser.
The police department says it was just an accident and no one is to blame.
Last November, Officer Greg Davis was behind the wheel when he struck Gerald Mitchell with his car. At first, police gave Mitchell a ticket for crossing at the intersection of 4th and West Main Streets at the wrong time. Now, the charges have been dropped and police are saying Mitchell isn't to blame, but neither is the officer who hit him.

You can't see Mitchell in the crosswalk at the intersection until the last minute. If you take a look at the cross signal, you can see it is red.
The accident sent Mitchell to the emergency room. We were not able to reach Mitchell Monday by phone. But Mitchell, an artist, has told NBC29 that the accident left some permanent damage that gets in the way of his artwork.
Police say they don't expect any charges against Davis even though Mitchell isn't at fault.
"We are sorry that Mr. Mitchell was injured. I am sure Officer Davis feels the same way. However, this was an accident," said Lieutenant John Teixeira with the Albemarle County Police Department.
The charges against Mitchell were dropped last week. Albemarle police are still investigating the situation internally.

I guess it depends on your laws, but a pedestrian in a crosswalk usually has the right of way here - especially if he was in the middle of the crosswalk when it changes.



I thought it was kinda scary that cross traffic rolls on thru, even when the patrol car is still in the intersection!

I don't think he counted as a pedestrian though, since he was in a motorized wheel chair...

Mitchell said that once he recovers, he wants to have a fundraiser to pay for lawyer fees. "I've got to do the right thing," he said of a possible lawsuit. "I can't walk away from this."

Not necessarily. Cities have their own muni codes for things like traffic/jaywalking.

I'm pretty sure people in wheelchairs are considered pedestrians in most places.
