FORT WORTH, Texas -- One suspected robber is dead and another is in fair condition at John Peter Smith Hospital after two Blue Mound homeowners fought back during a home invasion.
Keith Hoehn, 34, and his wife, Kellie, told police the men kicked in the door at their house in the 600 block of Globe Avenue at about 12:23 a.m. Wednesday.
"I turned around and in that moment I had a gun to my forehead and he told me, 'If you scream, I'm going to blow your brains out.' And I didn't listen to him, I screamed for my husband," Kellie Hoehn said.
Keith Hoehn said he opened the door to see a shotgun pointed right in his face.
"I kind of darted back a little bit thinking he was going to shoot me," Keith Hoen said.
At that moment, Kellie Hoehn said she made a quick decision.
"It's flight or fight, and I'm going to stay here and fight," she said. "This is my family."
She brushed the barrel aside, and a struggle ensued, which spilled out into the front yard. The husband disarmed the armed intruder and shot both. Keith Hoehn said he never had a second thought.
"They both had guns, they were both willing to kill us at any time," he said. "We thought we were dead, we thought we were dead people."
Dakota Benoit, 21, died at the scene. John Pierson, 25, ran away on foot but was later apprehended in the 2600 block of Lou Menk Drive, police said. Pierson's condition was upgraded from critical to fair shortly before noon Wednesday.
It is unlikely that the homeowner in this incident will face any charges, police said.
Police said the two men broke into another house in Blue Mound earlier on Tuesday night.
At about 11:10 p.m., the men, armed with shotguns, entered a Fort Worth home in the 2600 block of Calico Rock Drive through an open garage and confronted a 38-year old homeowner and his wife in their bedroom, police said.
Police said the men took a police radio, a laptop, a wallet, jewelry box and the victims' red Honda Odyssey.
There were no injuries reported in the first robbery

What a shame that one of these POS lived and will probably try to sue them now! It's too bad this doesn't happen more often.

I think our new "Castle Law" will protect them from lawsuits, since it happened at their home (the castle law protects people from lawsuits in their home, car, and place of employment as a result of defending themselves). So I guess it depends on exactly how far outside the home they were when he shot them.
In any case, deadly force appears to certainly be justifiable in this case so I have a feeling that it would be very hard to win such a lawsuit in Texas even if they were sued.

Castle laws, damn what have we come to when we need to pass a law to make something like this obvious.
Washington is a "no retreat" State with a "castle" law that has been in effect a long time. If you are charged for a self defense action, the State pays your attorneys fees for you when you win.
