I think it is funny that defense attorneys are attacking the results of an instrument or an officer's observations for their client[s] being intoxicated.
If the driver is impaired that should be the end of it. It doesnt matter if their BAC is .30% or .003% - every officer who removes an impaired driver off the road deserves a pat on the back.
Personally I make my impaired driving case by the PC of my stop, simple observations and field sobriety tests. Breath results from an instrument is just icing on the cake.Last edited by Billiardnut; 03-12-06 at 06:11 PM.

Yeah...I'd just get the doctor in to examine them and declare them unfit to be driving. That plus my statement as to their driving and state of intoxication is usually enough. Oh, and I'd bill them the £150 to call out the doctor
