Police officers made guardsmen lick up supposed urine, lawsuit states
Two Wisconsin National Guardsmen filed a federal civil rights lawsuit against the city of Wisconsin Dells, its police chief and three officers because they were forced to lap up what was believed to be human urine from the ground last summer.
The guardsmen, both of whom have served two tours of duty in Iraq, were in the Dells for weekend training and were stopped by police officers Wayne W. Thomas and Collin H. Jacobson early the morning of June 1 and accused of having urinated in public, according to a lawsuit filed Monday in U.S. District Court in Madison.
The officers pointed out a wet spot in an alley that they thought was urine, the lawsuit states, but the guardsmen, Sgt. Anthony R. Anderson, of West Bend, and Specialist Robert C. Schiman, of Kaukauna, denied having relieved themselves in the alley.
In order to prove that it was not their urine and avoid a citation, Thomas and Jacobson made Anderson and Schiman lick the ground and scrape mud up with their hands and lick it, according to the lawsuit.
Schiman also was made to eat a plant that was drenched in the liquid, the lawsuit states.
A third officer, Scott Albrecht, arrived at the scene and was told by Jacobson, "I can't stop laughing. Wayne just made those two guys lick their own piss off the ground," according to the lawsuit.
The suit alleges infliction of emotional distress on the soldiers; negligent hiring, training and supervision of Thomas and Jacobson; false imprisonment and violation of the Constitutional and civil rights of Anderson and Schiman.
It seeks $600,000 in compensatory and punitive damages for each of the guardsmen, along with other unspecified damages and costs.
Their attorney, Jason Baltz of Whitefish Bay, declined to comment on the lawsuit and said he had instructed his clients not to comment as well.
Wisconsin Dells Police Chief Bret Anderson, who is named as a defendant in the lawsuit, also declined to comment. He referred questions to City Attorney James Gerlach.
The lawsuit states that Thomas, 19, was fired the same day as the incident and Jacobson, 20, was suspended for two weeks without pay. Both were limited term police officers.
Albrecht was cited by the department for failing to follow procedures.
According to the lawsuit: After having forced Anderson and Schiman to lick the wet ground, Anderson was made to do it again after one of the officers said he didn't see it. "That's not good enough," the officer said. "Do you want a ticket?"
After the two were released from the scene without being cited, they told their story to Albrecht. As Albrecht stood by, Anderson and Schiman asked Thomas and Jacobson for the name of their commanding officer, but were threatened with burglary charges if they filed a complaint. The police officers told the soldiers that nobody would believe them.
After the two soldiers filed complaints that night, Sgt. Perry Mayer, the commander on duty, interviewed the three police officers and looked at the scene of the incident. The Soliders aren't saints, they were obviously pissing in an alley way and couldn't man up to it...pathetic. However, the officers actions were completely inappropriate. But what the hell did they expect when they hired a freaking 19 year old and 20 year old kid to be policemen?

I have pissed in an alley, sure. Would I do that to get out of the citation, no way in hell. Scratch out my paper and send me on my way or don't scooter.

Not cool if it happened as the suit says. I have said this before, much to the dismay of young officers, but I personally think 25 or below is too young for most officers. Just not enough life experience. I'd be willing to bet that current officers under the age of 25 would say the same by the time they were 30.

Cid, I say that NOW and I am 21, almost 22. I have a lot to learn. When you have a degree you try to put it to use. Thankfully I was given a part time job to at least get me on my feet and give me some experience. I'm still working hard at it.
Total bla bla bla. Sorry. I agree though. More along the lines of certain people having to try and pick a career at the age of 18. I was unsure of a career choice and went with criminal justice. I got a two year degree and chose to stop there.

In Washington State, you can't even arrest a Guardsman on his way to drill.
As both an LEO *and* a reservist, I'd say the troops have to explain to their 'shirt why they were pissing in the alley, and the officers need to be severely reprimanded.I'm your huckleberry...

How stupid are the guardsmen to actually lick the piss???? That's when it's time to fess up and take your ticket. I'd go to prison before I'd do that. Better yet, if they had just fessed up from the start, they probably wouldn't even get a ticket, just a warning.

This is disgusting! I was in the area last summer and they had a kid working the main drag in full uniform, fully armed. i struck up a conversation, and he told me that he hadn't completed recruit school yet, but they were letting him work anyways. Unfortunately, even in L.E., you get what you pay for.

I'm glad the Sgt followed up that night and action was taken. That is going to save the Sgt's butt. Other then that I don't feel sorry for the officer that got fired. I think the other one should have also. There is no excuse for that behavior. That said the soldiers were stupid to even go for it.

I wouldn't of even talked to them unless I visibly seen the morning sunshine yellow stream of pee. Then, finding out they were military I would of said don't do that in public have a nice night, carry on, or be given a ticket.

That is just plain sad! I agree that in a lot of cases 20 or 21 yr olds may e a little too young to be a LEO, but you have to take it on case-to-case basis. There are plenty or people out there that are that age and are mature enough to handle the job.

I agree with CID about the age. I even started here extremely young, but don't feel I was worth anything until I was 24/25.
I heard a story of an older Chief Deputy at a Sheriff's convention when talking about hiring.
Some guys were talking about preferring only degrees, others only military, etc. The Chief Deputy when asked said he liked those qualities, but looks for a guy who is 28-30, been divorced, pays child support, has had a car re-po'd, and had to bust ass to make ends meet.
