    MUNCIE, Ind. A 26-year-old man and his father were arrested after an off-duty Muncie police officer complained about the man cutting in line at a Wal-Mart store. Police reports said Edward R. Pluhar Jr. of Frankfort cut to the front of the line at the Wal-Mart service desk Sunday. What he didn't know was that Officer Chris Kirby was waiting in the line.


    Kirby said Pluhar refused when Kirby asked him to wait his turn. Pluhar's father, 61-year-old Edward R. Pluhar Sr., then asked Kirby if he wanted to step outside. That's when Kirby reportedly told the men he was a police officer.


    Kirby followed the men into the parking lot where they scuffled. Other officers arrived and arrested both Pluhars. They were released after posting bond.
    Pluhar Sr., however, gave a different version of events leading up to his arrest.
    "There's a lot more to the story," he said.


    He said his son had waited in line for 25 minutes once and been sent by a clerk to exchange an item. When he returned, Pluhar Sr. said the clerk waved his son to the front of the line, and Kirby objected.


    He said his son tried to explain the situation, but Kirby insulted him, at which point Pluhar Sr. asked Kirby to step outside but Kirby laughed at him. Pluhar Sr. also denied Kirby's claim that the older man threatened to shoot him. He said he and his son tried to walk away from the confrontation, but Kirby followed them outside.


    Pluhar Sr. said Kirby never identified himself as a police officer and he only found out he was an officer from other police at the scene.


    "What I did was wrong, but that doesn't make what he did right," Pluhar said.
    Edward R. Pluhar Jr. was preliminarily charged with battery on a police officer, while his father was arrested on charges of intimidation and criminal recklessness with a weapon. Police said Pluhar backed into Kirby's leg as he attempted to leave the parking lot while Kirby was standing behind the vehicle.

    If it is a Walmart like the one in my area it has a camera system that rivals most casinos. I wouldn't risk my job over Pluhar's version of this story. The fact that officers were waiting outside the store tells me that it was enough of a mess for someone not involved to call on duty guys.

    MUNCIE -- City police said a Frankfort man picked the wrong time to cut in line at the north Walmart store on Sunday, setting the stage for events that landed both him and his father in the Delaware County jail.

    Edward R. Pluhar Jr., 26, was preliminarily charged with battery on police officer Chris Kirby, while his father, 61-year-old Edward R. Pluhar Sr., was preliminarily charged with criminal recklessness with a vehicle and intimidation.

    According to police reports, officer Kirby was off duty as he waited in Walmart's customer service line with his wife and daughter Sunday afternoon, and watched the younger Pluhar walk past him and directly to the service desk.

    The police officer told Pluhar Jr. he needed to wait his turn, but the Frankfort man purportedly refused.

    The elder Pluhar then allegedly approached the off-duty officer, told him to mind his own business and asked whether Kirby wanted to take the dispute outside.

    When Kirby asked Pluhar Sr. what his intentions were, the Frankfort man purportedly said he would kick Kirby's posterior and also suggested he might shoot him.

    Kirby then informed the father and son that he was a police officer and called emergency dispatchers to send an on-duty officer to the scene.

    The Pluhars then left the store, at 4801 W. Clara Lane, with Kirby following them to the parking lot and then standing behind their van as they attempted to leave.

    The van, driven by the elder Pluhar, allegedly hit the officer's leg. Kirby and the younger Pluhar then fought, reports said.

    Patrol officers Kevin Durbin and Jess Neal then arrived and arrested the father and son without incident.

    Edward Pluhar Sr. was released from the county jail Sunday after posting a $5,000 bond, while his son was released on a $2,500 bond.

    Kirby was the one who called dispatch to get an on duty officer there. He made the call while still standing in the line. As the guy was trying to hit Kirby with the vehicle, the on duty officers were just arriving at the other end of the parking lot.

    Amazing how just a couple of sentances edited out of the first article makes it appear like the officer was at fault, but the 2nd article cleared that up - The guy making a threat in the store, then assaulting the officer in the parking lot with the van sounds pretty clear-cut.

    What upsets me the most is the Kirby didn't even tell me about his little fun at Wally World until a day and a half later in roll call. hehe I think I have had a good influence on him though. I think the old him would have beat the f*ck out of both of those guys and put them in the hospital. But he actually handled himself well for having some ass clown threaten to kill him. Those jokers are lucky that Kirby wasn't armed when he was shopping. Trying to run over a cop isn't too smart. How Kirby got hit in the leg was that he was trying to jump out of the way like some bad Charlie's Angels rerun, and almost fully got out of the way. Where the rest of the assaulting happened was that he got up off the ground and (because the father had left the driver's door open to yell at Kirby to get the *uck out of the way) was able to get into the driver's door and turn off the vehicle and take the key so that the duo could not drive away. The dad started punching Kirby as he did this, and the son got out of the passenger seat and ran around the vehicle to start punching Kirby from the other side as well. Right then was when the other officers pulled up on them. Of course then the ass hats were trying to act like they had no idea he was a cop and of course they never made any threats. There's good security footage of Kirby showing his badge and ID to the guys. And they got good witness statements from the employees at the customer service counter.

    What the hell are you talking about?!?!?!? In the first article, the first half is the police's version of the events, and the 2nd half is the accused's version....pretty good textbook journalism there. If possible, you should try to get a comment from BOTH sides for your story. Lazy journalism is when you just write an article without seeking comment from all parties involved......

    I wouldn't go within 50 miles of a Wal Mart unarmed. I guess that's why I leave the house armed.

    I hope the officer starts carrying off duty now. Glad he's ok.
