Sean FilyawAUBURN - A Gwinnett police recruit has been charged with burglarizing an acquaintance's apartment in Auburn last week while in uniform.
The allegations have cost Buford resident Sean Filyaw, 24, his potential slot with Gwinnett County's largest police agency, authorities said Monday.
Filyaw, a cadet in the Gwinnett County Police Department's training academy, has opted to resign in lieu of being terminated, Gwinnett police spokesman Cpl. David Schiralli said.
He was given the option to resign because "he has yet to be convicted of the charges," Schiralli said.
Filyaw was arrested and charged with felony burglary Thursday for allegedly forcing entry into a second-story window at his former neighbor's apartment and carting out a PlayStation video-game console.
Filyaw admitted to police he didn't have permission to be inside the apartment, which is leased by Jacob Fleming, 20, but he claimed the PlayStation belonged to him, according to an Auburn police report.
Fleming arrived home Thursday afternoon to find Filyaw's Dodge Durango in his driveway and the alleged intruder inside his home. Fleming called police, who stopped Filyaw before he could drive away, the report said.
The report says Filyaw was wearing his cadet uniform at the time of his arrest and was also in possession of other property belonging to Gwinnett police. He has since posted bond at the Barrow County Jail.
Filyaw could not be reached for comment Monday.
Schiralli said the alleged actions of the cadet were frowned upon prior to his resignation.
"(Gwinnett police) will not tolerate the actions of any of its members that may reflect negatively on this department," Schiralli said.

What an idiot.
That being said, burglary here is unlawful entry or remaining upon a premises with intent to commit a crime. If it turned out that the property was in fact his, and he had no intentions to steal or commit other offenses, he would be charged with 1st Degree Criminal Trespass.
