    MYFOXNY.COM - One second a Staten Island teenager was walking down the street, the next second she was gone.

    Alexa Longueira was walking down Victory Boulevard and getting ready to text-message when she fell into an open sewer manhole. Now the city is trying to figure out why the manhole was left open and unblocked.

    Alexa suffered some cuts and scrapes but is otherwise OK.

    He mother says workers told her they left the manhole open and unattended for just seconds while they went to fetch some cones from their truck.

    The Department of Environmental Protection says it is investigating.

    "DEP is conducting a full investigation of what happened during a manhole incident on Victory Boulevard where workers were flushing a high-pressure sewer on Wednesday evening," said Mercedes Padilla, of the DEP. "We regret that this happened and wish the young woman a speedy recovery."

    Alexa's mom says it doesn't matter that her daughter was text-messaging, the manhole should not have been left open. The family plans to file as lawsuit.

    Agreed, though they should have brought the cones with them before they opened the manhole cover, it is highly probable that the teen was so engrossed in her "conversation" that she wasn't looking where she was going.

    I hope the judge laughs her and her family our of court. Damned sue happy morons.

    Some of them will probably get fired unless there's a union. At least one of them probably should be fired, unless someone stole the cones. Some or all of them are probably responsible for making sure the hole is marked and everything is safe.

    But like you say, it may not have made a bit of difference.

    Really? Fired? Obviously there's a safety protocol being violated here, maybe worthy of some internal discipline. But let's be honest. Manholes are freaking huge. Sure, the procedurally-correct thing to do would be to cover it up while they make the (probably 25ft) walk back to the truck for cones, but they were probably thinking that most people aren't complete bags of soup who would wander blindly into a three foot diameter hole in the ground. Like you said, if the gaping hole in the ground isn't warning enough, cones probably wouldn't have helped this pitiful chick out. So because this idiotic teen bitch wasn't paying due regard to her surroundings in a public place in the middle of NEW YORK F'ING CITY, this guy should lose his job in this economy? I don't buy it.

    I'm just assuming the policy (and probably OSHA regs) say to put barricades down, THEN open the manhole, or at least have someone standing by to keep idiots like this from stepping in it.

    If I were on a jury, I'd probably vote to cover her medical bills but nothing else - really all I'd be doing is making the city reimburse the insurance company, assuming she has insurance, because the insurance company is the only totally innocent party. They both share about 50% of the blame, but the bottom line is that the city is the one that created the hazard.

    She's a dumbass for not watching where she was walking, but she didn't create the hazard - she just failed to notice a hazard that was already there.

    Probably more like Ohhhh CRAP!

    DEP are city workers, doubtful they will get fired, reprimanded maybe. After that article hit the news I am sure every five and dime attorney reached out to them advising them to file a claim. The City would most likely settle the lawsuit before it even goes to court, they usually do.
