    Not leaving a tip? You may be arrested

    If you’re frustrated by poor service at a restaurant, think twice before you decide to not tip. You may be in for a bit more than just a dirty look from the waiter.
    "Nobody, nobody wants to be forced to pay a tip or be arrested for terrible service," Leslie Pope said when her happy hour ended in handcuffs.
    Pope and John Wagner were hauled away by police and charged with theft for not paying the mandatory 18 percent gratuity totaling $16 after eating at the Lehigh Pub in Bethlehem, Pa. with six friends.
    Pope claimed that they had to wait nearly an hour for their order and that she had to get napkins and silverware for the table herself.



    “At this point I became very annoyed because I had already gone up to the bar myself to have my soda refilled because the waitress never came back,” Pope said.
    After the $73 bill came, the group paid for food, drinks, and tax but refused to pay the tip. After explaining the bad service to the bartender in charge, Pope claimed he took their money and called police. The couple was handcuffed and placed in the back of a police car.

    Hopefully with enough publicity, people will see just how this business treats their customers. My guess is they will be regretting this shitstorm that they caused. It it is that busy, then hire more help or your customers will be going elsewhere. Word of mouth travels fast.

    Interesting in that this article was posted on Nov 18, and Updated 12:20 PM EST, Thu, Nov 19, 2009 and has 1415 posts in the comments as of 9:25 EST.

    I wonder if there's more to the story. It doesn't seem rational for the restaurant owner to want to get such bad publicity for $16.

    Is mandatory tipping common in some places? I have never seen it anywhere around here, except for large groups.

    As long as it is posted as mandatory, it seems that it would be part of the bill so they were wrong not to pay it.

    If it's on the bill, it's on the bill and you owe it.


    But at the same point, if it's on the bill as a "gratuity" or posted as a "gratuity" then I'd say they have every right to not give it.

    2. something given without claim or obligation


    I would say the restaurant shouldn't call it a gratuity. Or, their customers should go elsewhere if they don't agree with a mandatory "gratuity."

    Agreed. They should call it what it is , a service charge.

    I agree. Many restaurants charge an 18% gratuity/service charge when serving groups of 6-8 or more, and that policy is printed on the menus. If you don't like the policy, go somewhere else. I do agree that it should be listed as a service charge as opposed to a gratuity.

    I have seen the same 18% for large groups, but we rarely go out in a group. But if I went somewhere and they automatically added the tip, I would not go back again. Most people aren't going to notice that on the menu and if they did would probably think it had to do with large groups and wouldn't really take notice. I think what the restaurant did was uncalled for personally, especially when the service was so bad that the couple basically had to serve themselves.

    I've been places where they add it automatically and don't tell you. I only caught it by looking through the bill item by item. I've also been other places where the server said it's already been added in so please be aware of it so we didn't double tip.

    But at the same time I can give some really good tips when someone goes out of their way to help me out.

    I don't tip one penny more when its added in. I think tips should be a reward for good service and not something someone is entitled to. I do take into account someone that is new or training...as long as they are really trying.
