    Navy SEALs have secretly captured one of the most wanted terrorists in Iraq — the alleged mastermind of the murder and mutilation of four Blackwater USA security guards in Fallujah in 2004. And three of the SEALs who captured him are now facing criminal charges, sources told FoxNews.com.
    The three, all members of the Navy's elite commando unit, have refused non-judicial punishment — called an admiral's mast — and have requested a trial by court-martial.
    Ahmed Hashim Abed, whom the military code-named "Objective Amber," told investigators he was punched by his captors — and he had the bloody lip to prove it.

    Unfortunately, this wouldn't be the first case of "NJP for doing your job" I've seen. At least these guys have the cajones to exercise their right to a court martial. Hopefully an independent review will see the light.

    I can't explain how disgusted I am by this. Just another sign of the times, I'm glad they are going in front of a jury though.

    Does a court martial give them a jury trial option? I hope they can get a jury trial - i bet no jury in the USA is going to convict them of punching a terrorist. A hung jury with one or two Obamaites voing guilty would be about the worst they'd get from a jury, I think. I wouldn't put it past the terrorist to have punched himself.

    The other part of that story is probably also why the Blackwater guards on trial for shooting Iraqis shot first and asked questions later - Did that shooting come before or after the Blackwater guards were killed?

    A courts martial is by definition a jury trial for a capital offense, and can be a jury trial if requested by any defendant for a lesser offense.

    Remember the UCMJ is still subject to the Constitution, and the right to trial by jury still exists.

    (The system is very much like a misdemeanor or felony court in this regard, where even the size of the jury is different.)

    A Court Martial with a jury is constituted of 6 officers from various ranks, not civilians. The fear of the typical foaming at the mouth Obama zombie is greatly lessened, but not totally reduced, in that scenario.

    The SEALs are right. I wouldn't take NJP either when I know I am in the right. Let the Court Martial sort it out. I would rather let my fellow soldiers judge me than some administrator who wants to expeditiously brush it under the rug and make me swallow something to make it less painful for everybody.

    Major Winters (Easy Company, 502nd, aka Band of Brothers) didn't do it in WW2 when Captain Sobel tried to screw him and give him NJP. He requested a general Court Martial and Captain Sobel dropped it right quick.
