    Man goes away for two days, comes home to new people in his house

    A pensioner who took his dogs out for a walk returned to find a family had moved into his home.
    George Pope, 72, was unable to get into his council house because the locks were changed.
    Mr Pope left his home in Barking, Essex, to take his dogs out to nearby Parsloes Park last Thursday, September 16.

    Alot of officers would have handled it diffrently.
    From what was posted I would have locked up the squatters for something, damage/abstract electricity etc etc or assisted the homeowner in ejecting them from the house.
    You cannot just take over a house that is occupied.Even if the occupant is away for a short time.
    Otherwise every time you left your house empty someone could potentially move in to your house.
    One of the issues may well be that as the occupier was renting the property he doesn't have the same rights as an owner. The landlord is technically the owner and this may be where the grey area came in. However the squateers cannot damage his personal property and that is how I would have got round it.

    The paper it was in also very often fails to tell the whole story always slanting their stories towards the more right wing viewpoint, and very often anti law enforcement.

    We have a scam going on here that as people are being foreclosed on they are renting their house out so the bank soon evicts them all the while the previous owner pockets the money till the eviction. Or they will take deposit money from several different people then split and not really rent it to anybody.

    Let me get this straight...

    Someone with no authority to do so collects a substantial sum and lies to the people, telling them that they have a 6 month lease on the property. Then, when the rightful tenant returns -- the police tell him it's a civil matter?

    How is it a civil matter? The guy who leased the house to the squatters had no right to do so, therefore he had no way to give them a legal right to it. So... the squatters had no right to be in the house! Period. No civil matter. Otherwise... I'm going to rent every house in England today! I'm offering bargain rates: $100 US. Occupancy available immediately.

    I did have a case that was more confusing. Car was stolen. Reporting agency in another state dawdled for 2 weeks on putting it into NCIC. Meanwhile, car gets towed in my state. Tow company does proper (if minimal) legal process to be able to sell it at auction, and does so. It proceeds to pass through two more sets of hands in private sales. Meanwhile, the car gets entered into NCIC, and the insurance company pays off the original victim, essentially buying the car off of them. One day, one of our patrol officers runs the tag (yep, they sold it with the old tags...) and discovers it's a stolen car... leading to my work on the case. So -- really, I have two owners: the guy who bought it at auction (titles haven't been transferring in the private sales... 'cause the guy who bought it at auction is having trouble getting a new title on it from DMV, but he does have the legal bill of sale from the auction), and the insurance company. Yeah -- final resolution of who owns the car was a civil matter!

    Personally JKS my call is that it wasn't a civil matter but I'm afraid I've come across quite a few jobs(not just from the Met police, but mostly) where officers call it civil as its in the too diificult/can't be arsed to sort out box.

    We quite often get the scenario with the car, but basically title always remains with the original loser(insurer if they've paid out) It is rare for the innocent purchaser to get any money back. The police occasionaly seize a vehicle and then put it before the court to make a decision in such cases(called Police property Act) but again it almost always goes back to the original owner.

    Stopped a guy in a stolen car who had just paid £5000 to someone to buy it. he thought it was above board but hadn't made any checks as it was still on the stolen plates. The car was seized and went straight back to the owner and he was £5000 down. Hard lesson to learn.
