    A federal court jury today ruled that two former Birmingham police officers were not guilty of using unreasonable force and violating the civil rights of a man arrested after a 2008 high speed chase.

    Barrett G. Dewitt and David Doran had been indicted by a federal grand jury for using unreasonable force in the arrest of Anthony Warren on Jan. 23, 2008.

    After jurors left the courtroom, family, friends and police officers hugged former officers David Doran and Barrett G. Dewitt.

    "We're excited for our client. We're excited both men are not guilty," said Emory Anthony, one of the attorneys for Dewitt.

    Dewitt, 40, and Doran, 37, did not comment after the verdict on the advice of their attorneys because a federal civil lawsuit filed by Warren is still pending against the two officers and several others involved in the 2008 chase.

    "He (Dewitt) was an officer just doing his job trying to prevent a man from wreaking havoc in the community," Anthony said.

    Dewitt and Doran had been indicted by a federal grand jury for using unreasonable force in the arrest of Anthony Warren on Jan. 23, 2008.

    Doran and Dewitt were two of five officers fired from Birmingham's police force in 2009 after videotapes of the chase and Warren's arrest came to light.

    The 8-woman, 4-man jury could have found the men guilty of the charge, not guilty of the charge or convicted them of a lesser, misdemeanor. The jury found them not guilty.

    Everett Wess, the other attorney for Dewitt, called Doran and Dewitt heroes. "I think this frees the police throughout the metro area to do their job," Wess said.

    I understand the emotions and have no sympathy for the driver. I don't know who was who as far as the officers involved on the video are, but after watching the whole thing, there are a couple in there that didn't hit the guy and backed-off when they saw he was unconscious. I have to say, though, in all honesty, that there was what I would consider excessive use of force by some of the officers. JMO.

    I agree, not everyone there needed to be fired or charged just because they were the first to arrive. The first officer was really lucky, someone was watching out for him.

    I can't tell what the suspect was doing, as he was obscured by the officers surrounding him. What the suspect was doing seems key. I assume the jurors had more info than the article and the video provide. Strange that the officers were fired before the verdict--shouldn't they have waited till after the verdict to make that decision?

    This video makes me sick. I understand the emotions after seeing another officer either getting hit or nearly getting hit but the job of the police is to stop and take into custody. The guy was thrown from his car and was knocked unconscious at that point they should of placed him into custody. I would not have a problem if they would of jumped on him to cuff him but to beat him that way when he was unconscious is absolutely ridiculous. These guys should not be on our street protecting us when they can not control their temper.

    Sam, you are correct in saying that police officers are not "judge and jury". In this case, the judge and jury have spoken and have found these two officers not guilty. That judge and jury has been exposed to a wealth of information we are not privy to. Your disagreement with their verdict is noted, and you are certainly entitled to your beliefs.

    This will not turn into a bash of those who disagree with you, or of this site.

    Yes it does. I would have to start with how cold the suspect driver was by intentionally trying to strike the officer. However I also agree that officers are not judge and jury.
    I would like to point out that I am not familiar with the department in question nor the laws of that state. That being said the officers may very well have been exonerated due to acting within their departmental policy and without violating the law. I would have to research that.
    It is difficult to have the desire to seek justice for others and be completely devoid of emotion while doing it, which is what is generally expected. That actually sounds a little strange when I read it since having an emotional response to injustice for others is the reason I desire to seek justice for others. There are also times when an officer is faulted for dealing with a situation without showing emotion. It is a thin line we walk.

    They want their jobs back? At an agency that is so quick to throw them under the bus? They need to sue that city and get hired elsewhere.
