More: Grand jury declines to indict McDonald's worker in beating - CNN.comNew York (CNN) -- A fast-food worker whose run-in with two unruly customers was captured on cell phone video last month will not be indicted on assault charges, prosecutors said Saturday.
A grand jury voted against indicting Rayon McIntosh, who was seen allegedly swinging a metal object against two patrons at a McDonald's restaurant in Manhattan's Greenwich Village.
He had been charged with felony assault, according to Joan Vollero, spokeswoman for the Manhattan district attorney's office.

Can you really justify hitting unarmed women with a metal rod while they're on the ground and no longer a threat? One woman had a fractured skull. I understand why the guy initially hit them, but I think he quickly crossed the line from self defense to assault. I think he was lucky not to be indicted, especially in NYC. I doubt he'll fare so well if they file a civil suit. Just my $0.02

I guess the video doesn't show what they were doing on the ground though. Could they have been reaching for a weapon? Nobody really knows what happened, and the video shows only a very small part. Even if it had gone to court, I think it would have been an uphill battle for the prosecution.
