DEFENDANT ATTEMPTS TO USE STOLEN CARD WHILE STANDING NEXT TO OFFICER
It's all a matter of timing, as an Alliance patrolman investigating a stolen credit card found out Wednesday night.
Patrolman Seth Busche was investigating a report that the card had been used at Main Street Marathon when the alleged perpetrator walked in and attempted to use it again, as officers were taking the report.
Officers arrested John Michael Funk, 27, who is listed as homeless, at 10:30 p.m. Wednesday on charges of two counts of theft from an elderly person and a single count of receiving stolen property, all fifth-degree felonies.
Bair and Busche were dispatched to the 500 block of South Arch Avenue, where they spoke with Funk's 60-year-old mother, who allegedly stated he took her credit card without permission and used it to purchase cartons of cigarettes.
According to Busche's narrative, while he was taking the report, Funk walked in and "attempted to use the credit card again while I was standing next to him."
Funk was booked on the charges and transported to Stark County Jail, where he was released as a nonviolent offender.
He is set to be arraigned at 1 p.m. today in Alliance Municipal Court.
