Product Liability Lawsuits Dismissed Against TASER
17th, 18th and 19th Product Liability Lawsuits Dismissed Against TASER International:
James Ruggieri Withdraws as Expert
SCOTTSDALE, Ariz., May 22, 2006 (PRIMEZONE) -- TASER International, Inc. (Nasdaq:TASR), a market leader in advanced electronic control devices announced that the U.S. District Court for the Northern District of Florida, Tallahassee Division, entered a judgment of dismissal ordering the dismissal with prejudice of the product liability lawsuit filed by Antonio D. Lewis, et al. against TASER International, Inc. In addition, the U.S. District Court for the Eastern District of Missouri, Northern Division, entered an order dismissing with prejudice the product liability lawsuit filed by David Lash, Sr., et al. against TASER International, Inc. Also, the U.S, District Court for the Middle District of North Carolina entered an order dismissing with prejudice the product liability lawsuit filed by Carol Blair, et al. against TASER International, Inc. Dismissal with prejudice prohibits the re-filing of these lawsuits in the future. These are the seventeenth, eighteenth and nineteenth wrongful death or injury lawsuits that have been dismissed or judgments entered in favor of TASER International.
In the court order granting TASER's motion to dismiss in the Blair lawsuit, the Court stated "...the Court concludes that Plaintiff has failed to state a claim upon which relief may be granted against Defendant TASER International." The Court also stated, "Specifically with respect to the use of tasers (sic), courts have held that officers may use a taser device in various contexts to subdue belligerent or unruly arrestee, inmate or detainee."
"Our strategy of aggressively defending these product liability lawsuits is continuing to show results and we will relentlessly fight these lawsuits with the overwhelming medical and scientific evidence showing that the TASER(r) device was not the cause of injury or death," commented Douglas Klint, Vice President and General Counsel for TASER International. "We believe a key factor in the plaintiff's decision to voluntary dismiss the Lewis lawsuit was the abrupt 'quitting' of their purported expert, James Ruggieri, as an expert witness days before his scheduled deposition. In a prior deposition, Mr. Ruggieri admitted that he is in fact a high school dropout with no engineering degrees. In addition, independent expert analysis of his most recent report on electro-shock weapon safety in the Journal of the National Academy of Forensic Engineers documented the simple math errors he made resulting in an exaggeration error of 69,920% in his power calculations for the TASER device."
"We are confident in the medical science and the world-class quality of our experts supporting the TASER device and we are prepared to continue to aggressively expose any expert the plaintiffs may offer against us in litigation," concluded Klint.

Taser is just like Smith & Wesson, they have no liability. They clearly warn police departments and sheriff's offices that the weapon can cause death.
The product didn't kill anybody, the person using the product did.
Taser is simply able to get it's own ass off the firing line of a jury. I don't see them helping departments or officers do the same.

That is excellent, so we may able to finally be able to carry them. The 007th and 011th districts were pilot districts for the PO's carrying tasers, now only Sargeants carry them (and a lot are scraed to use them). We had a guy who was all cranked up on meth, who had barricaded himself in somewhere, and when he got zapped he died. The Crook County Coroners office said the taser caused his death, not the .18 (don't know the measurement) over the lethal limit of meth.
