Damages for Wrongfully Convicted Man Denied

(08.08.06 - AP) — A federal court jury today refused to award any damages to a man who spent 27 years in prison before he was freed by a DNA test and pardoned.

The jury deliberated for a day and a half before finding that none of the 10 police officers sued by former prisoner Michael Evans was liable for damages.

The 48-year-old Evans was sent to prison at age 17 for the rape and murder of 9-year-old Lisa Cabassa. He spent 27 years behind bars before a DNA test proved he did not molest the little girl.

Evans later was pardoned along with co-defendant Paul Terry, who also has a civil lawsuit against the police pending.

None of the 10 police defendants was in court for the verdict. Their attorney, Andrew Hale, said the verdict indicated jurors felt police had done a good job of investigating the case.
