Slave descendants attempt to revive reparations suit

    September 27, 2006
BY ASHLEY M. HEHER Associated Press
Lawyers for slave descendants asked a federal appeals court Wednesday to a revive a landmark reparations case that demands 17 of the nation's insurers and banks publicize and pay for their roles in the country's slave trade.

The case, which names Wall Street behemoths JP Morgan Chase & Co., Aetna Inc., Bank of America and others, says the companies' predecessors issued loans to slave owners and, in some cases, owned, insured and transported slaves -- all at a financial profit that helped ensure their success today.

''I am here seeking justice for the physical damage, emotional damage,'' said Antoinette Harrell, a genealogist from Kentwood, La. who clutched raw cotton as she spoke inside a federal court house Wednesday. ''We were left in poverty. My family's hardship and free labor was not in vain.''

But lawyers for the companies told a panel of judges at the U.S 7th Circuit Court of Appeals in Chicago that the case is without merit and the corporations did nothing to harm the current-day descendants.

''These are inherently speculative claims,'' said lawyer Owen Pell.

The three-judge panel -- led by Circuit Judge Richard Posner, who asked lawyers about whether their clients could prove slavery caused current day financial losses -- seemed to agree.

''If you think you've been wronged, it shouldn't take 100 years to investigate the conduct of Aetna, Lehman Brothers and the like,'' said Posner said. ''There are a lot of people living today whose parents were wealthy in the 19th century who have nothing.''

Wednesday's hearing comes at a pivotal time for the reparation movement.

This summer, the Moravian Church and the Episcopal Church apologized for their roles in the slave trade and a North Carolina commission urged the state to repay descendants of a violent 1898 white supremacist campaign in Wilmington, N.C.

And corporations have begun to acknowledge their ties to slavery, in part because of a series of state laws requiring companies to do so.

Several cities -- including Chicago, Detroit and Oakland -- also have laws requiring businesses to make such disclosures.

''Slavery was not a local occupation -- it was facilitated and made possible by the great northern banks that today sit in our great cities of New York, Chicago, Boston and Los Angeles and San Francisco and all over the country,'' said Bruce Afran, a lawyer representing Deadria Farmer-Paellmann, whose family members were slaves in South Carolina.

JP Morgan Chase has acknowledged it owned 1,200 slaves in Louisiana and accepted 13,000 others as collateral before slavery was abolished in 1865.

Lawyers pushing for the compensation said Wednesday the current day ''market value'' of the company-owned slaves would be at least $850 million.

The company has since apologized for its role in slavery and funded a $5 million college scholarship program for black students from Louisiana. Company spokesman Tom Kelly declined to comment on the litigation.

The case made its way to the appeals court after the lawsuit was dismissed last summer by a federal judge, who said the debate about reparations should be decided by the legislative or executive branch.

Lawyers pushing for the reparations said if their arguments are rejected again, they'll ask the U.S. Supreme Court to consider the case.

If the reparations advocates succeed, the companies will have to account for the income they earned from slavery, produce historical records and give up the profits earned from slavery. The damage awards would be used to create a court-supervised fund to help fix problems in the black community.

''The companies that benefited from slavery must share their wealth,'' said Richard E. Barber Sr., a Somerset, N.J. resident whose grandfather, great-grandfather and great-aunt were slaves. ''This issue must be resolved in my generation.''

Ok, not to piss anyone off, but I am tired of hearing this bullshit. I have Irish blood running through my veins, and my ancestors came to this country and were subjected to a lot of the same work practices. Tired of hearing it, in the ghetto I work I hear about reparations all the time, and I always reply the same way, do I not give you enough of my check? SSI, Food, Housing, Welfare, Utilities. You live in a housing project and drive a nicer car than I could ever imagine owning. I am tired of hearing about reparations.

Same feelings here, Pedro. Yet again, the idea of personal responsibility rears its ugly head. I wonder how they'd feel if they realized that in many cases it was their own tribesmen who originally sold their ancestors into slavery, or that it wasn't limited to blacks? Everyone race and creed has fallen into hardship at some point in time, mostly at the hands of others. Deal with it, and be glad you're not still dancing around the ceremonial fires and instead live in the best country in the world.

I second that, and can almost comment verbatim. I am Italian and I am fortunate enough not to work in the ghettos.

Excellent post, Ducky. I wonder too, how many people - black or white - realize that there were black slaveowners who owned and profited from black slaves in the U.S.

All I can say is IF they ever got it I'll start finding decendants of all those ancestors who were poor farmers that could have had a better life, if it were not for slaves doing all the farming or other work.

Most of my ancestors on both sides were farmers, some well known and some poor.

On a serious note, many people don't realize that there were blacks who owned blacks. They don't teach it in schools, no one wants to talk about it.

It's not just that there were slave owners that were black, not all of the slaves were black either. Even today there's a thriving white slave trade. Natural blondes and redheads - especially redheads - who are attractive fetch a surprisingly high price. They don't stay attractive for long, though.

There were also Native Americans who were slave owners....I read in the geneology forum of one person who was a slave owner, although that person did not own many.

TRUE... Just like they don't teach that Abe Lincoln violated so many people's rights it wasn't even close to being a joke... Yet he is regarded as a HERO... And woe to anyone who tries to enlighten a public school teacher or even others of our higher education system!!

Sorry, but if anybody deserves reparations in this country, it's the Indians!!

Ok, Gotta throw my two wooden nickles in....

Ditto with Ducky on this plus another thought....

"Be Glad that YOU are alive today" to enjoy what you have.

How many of our fellow americans out there aren't? How many suffered persiscution unto death?? Considering that most of my ancestory was Native American (Cherokee, Choctaw, Chickisaw, and Creek respectively) and the biggest reason I'm alive today is that my ancestors were escapee's off the trail of tears that hid in the hill country of Alabama, I'm just extremely greatful that I"m here to share the company of Ducky and Everyone...

Lets face it..the only way all the "bad blood" is ever going to go away is if people STOP holding on to the bad feelings... Let the predjudism just Die and lets share this world....

    Again, just my opinion....

I am not my great-great-great-grandfather's keeper.

Whatever he did to you, go dig him up and make him pay for it...

And not only were there black slave owners, but many of the slave traders in Africa were black too - Most of which sold conquered tribes into slavery. Go see them about it and demand reparations.

I always thought that the only appropriate reparations were a 1 way ticket back to your country of origin and a free grass hut.

Who was Dave the Slave? Potter? Poet?

Dave the Slave was an enslaved African-American potter who turned wares in the plantation potteries of Edgefield South Carolina before the Civil War. He made pottery from as early as the 1820s to the mid-to-late 1860s. Dave is famous mainly for two reasons. First, he had the ability to turn large pieces of pottery, forty gallons or more in size. This was an incredible feat. Secondly, he would sometimes write on the sides of his ware. It was against the law for slaves to learn to read and write in the antebellum South but Dave could and did. Dave sometimes wrote his name and date on his pottery and on very rare occasions he would write short two line couplets or short poems.

Anyone hear of him or have any of his pottery?
