The investigation into the fatal head-on traffic crash involving a Marion County Deputy Sheriff Saturday night on Highway 99E north of Gervais is continuing. Deputy KELLY JAMES FREDINBURG, age 33, was pronounced deceased at the scene. One of the three occupants of the other vehicle died early Sunday morning at Oregon Health Sciences University. The on scene investigation confirmed the impact occurred in the southbound lane.
Preliminary investigation by Oregon State Police, with the assistance of the Marion County District Attorney's Office and Keizer Police Department, indicates that on June 16, 2007 at approximately 11:30 p.m. Marion County Deputy FREDINBURG was southbound on Highway 99E near milepost 36 responding to another department's call for assistance. The Deputy had his marked patrol car emergency lights and siren activated and two other northbound vehicles had begun to pull to the shoulder to yield to the deputy's patrol car. A third northbound vehicle, a 1998 white Ford Crown Victoria with three occupants, drove across the centerline into the southbound lane. Both vehicles crashed head-on in the southbound lane then came to rest off the west side of the highway. The Deputy's patrol car overturned and caught fire. The other vehicle did not catch fire.
State, county and local police agencies along with local fire personnel responded quickly to the scene. The fire was eventually extinguished by Woodburn Fire Department. Deputy FREDINBURG was pronounced deceased at the scene.
Two occupants of the other vehicle were at the scene seriously injured. Both were transported to Oregon Health Sciences University, one by LifeFlight air ambulance and one by ground ambulance. One of these individuals, a 19-year old male, died at the hospital and the other, a 20-year old male, is in critical condition.
While investigators were at the scene they were notified that an injured person came into the emergency room at Salem Hospital. An Oregon State Police (OSP) trooper responded to the hospital and confirmed this person, a 24-year old male, was a third occupant in the involved vehicle. His injuries are believed to be non-life threatening.
Confirmation of who was driving the northbound car is pending. The Marion County District Attorney's Office has requested their identities be withheld pending further investigation.
Oregon State Police troopers and detectives from the Salem Area Command office are investigating the crash with the assistance of OSP collision recontructionists and the Marion County District Attorney's Office.
Marion County Sheriff's Office has activated their Critical Incident Trauma Team to assist their employees during this difficult time. Deputies came to the scene and escorted the victim to a local mortuary.
Deputy FREDINBURG joined the Marion County Sheriff's Office in August 2006. Prior to joining their law enforcement agency, Deputy FREDINBURG worked six years for the Polk County Sheriff's Office as a corrections and patrol deputy.
An avid fisherman who loved his family, Deputy FREDINBURG is married and has two daughters, ages 12 and 3.
Additional information regarding Deputy FREDINBURG and any plans for upcoming services will be released through the Marion County Sheriff's Office.
Highway 99e was reopened about 7:00 a.m.

RIP Brother. I attended Deputy Fredinburg's Memorial and Ceremony Last week. It was a real reality check. I don't think there was a dry eye in the armory during the Memorial, then the procession went to the Oregon DPSST building, where they put his name on the Wall of Heroes, retired badge# A185, and did the Last Call. If there were any dry eyes at the ceremony, they let the tears out during the Last Call for sure.

Oregon State Police and Marion County District Attorney's Office is asking for the public's assistance in locating a Woodburn man wanted on homicide charges related to a June 16, 2007, fatal motor vehicle crash on Highway 99E near Gervais. The two-vehicle crash resulted in the death of two people, Marion County Sheriff's Deputy KELLY FREDINBURG and OSCAR OSCENCIO - AMAYA.
A warrant exists for the arrest of ALFREDO De JESUS – ASCENCIO, age 20, from Woodburn. On June 16, 2007, around 11:30 p.m., De JESUS - ASCENCIO was the driver of a Ford Crown Victoria northbound on Highway 99E when it crossed into the southbound lane and collided head-on with a southbound Marion County Sheriff's patrol car driven by Deputy KELLY FREDINBURG, age 34.
The Marion County Sheriff's patrol car caught fire and Deputy FREDINBURG was pronounced deceased at the scene.
De JESUS – ASCENCIO was critically injured and transported to Oregon Health Sciences University (OHSU).
Two passengers were traveling with De JESUS – ASCENCIO. Right front passenger, OSCAR ASCENCIO – AMAYA, age 19, died from his injures the next day at Oregon Health Sciences University. A second passenger received minor injuries and was taken to Salem Hospital where he was treated and released.
De JESUS - ASCENCIO is described as a Hispanic male, 5'4" tall, 140 pounds, with dark hair and brown eyes. As a result of the injuries he suffered in the crash, he is believed to be using a walker. He was last known to be in the Woodburn area on August 9th.
Anyone with information regarding the whereabouts of ALFREDO De JESUS - ASCENCIO is asked to contact Oregon State Police Northern Command Center dispatch at 800-452-7888.
No further information related to this investigation will be released without authorization of the Marion County District Attorney's Office.

I don't believe they were going to charge him with it until it went to grand jury. The grand jury made the decision of the homicide charge. There were a lot of angry people out here in Marion County, that believed he should have been arrested on it too. I just hope they catch him now that he's on the run.
