    Off Duty Birmingham Officer Killed by Gunfire

    BIRMINGHAM, Alabama - Authorities on Monday charged an Ensley man with capital murder in the fatal weekend shooting of an off-duty Birmingham police officeroutside a Bush Boulevard convenience store.
    Patrick Johnson, a 40-year-old husband and father, was arrested early Sunday at his 43rd Street home. Birmingham police and U.S. Marshals took him into custody between 1:30 a.m. and 2 a.m. just several hours after the deadly shooting. The registration on Johnson's recently-bought motorcycle, which was found not far from the crime scene, helped lead lawmen to the suspect.
    Johnson is charged in the slaying of West Precinct Officer Keary Hollis. District Attorney Brandon Falls said the shooting warranted capital murder charges because it involved shooting into a vehicle. Johnson will be held without bond at the Jefferson County Jail.
    Hollis, 35 and also a father, was shot to death about 10:15 p.m. Saturday outside of Bush Hill Quick Mart, also known as Triple T's. Hollis had been on the Birmingham force for 5 years.
    The ordeal unfolded just after 10 p.m. Saturday. Several witnesses spoke to AL.com about what happened, but asked that their names not be used. A store worker said both the suspect and the officer were frequent customers of the store, but there isn't any indication they knew each other.
    The suspect, later identified as Johnson, had come in to buy something and was sitting outside on a plastic crate when the Officer Hollis accidentally backed into the suspect's motorcycle, knocking it over. The employee said Hollis had been in the store earlier in the day and said he would be back later to buy a cap.
    A woman who was just pulling into the convenience store said the suspect got angry with the officer, who wasn't in uniform, about of hitting his motorcycle with his car. The two exchanged words, and the officer began to drive off. The suspect followed him on foot to the end of the parking lot and fired four shots, according to the witness.
    "He dumped four shots on him," the woman said. The officer's car spun off into a vacant garage on the corner of Avenue Y and Bush Boulevard.
    Johnson began to ask people in the parking lot for help getting his bike off the ground. Several people did help him, she said. The witness said the suspect kept backing up the motorcycle, but did not crank it.
    The witness, who is a registered nurse, and another man ran over to the gunshot victim. She said the officer was in the driver's seat but slumped into the passenger side and bleeding from the left side of his head.
    Johnson's motorcycle was found abandoned nearby. Authorities ran the registration on the motorcycle and it came back to a North Alabama man. They learned from him that he sold the motorcycle to Johnson recently off of a Craigslist ad. Surveillance photos from store video in addition to tips from informants quickly led police to Johnson at his 43rd Street home.

    Court records show Johnson doesn't have any prior criminal convictions in Alabama. He was arrested in 2007 on charges of carrying a pistol without a license and drug possession, but those charges were dismissed.
